Protecting the Constitution

I took an oath to protect and defend the Constitution when I enlisted in the Army and again when I was sworn into Congress. I take this oath very seriously.  I am concerned with recent infringements on the Constitution, especially the First, Second, and Fourth Amendments. And the Constitution is more than just the Bill of Rights -- it also lays out the enumerated powers of the federal government, and particularly Article I, Section 8, which lays out the powers of Congress. Too often Congress passes laws that go well beyond the authorities listed in the Constitution. Finally, the Constitution lays all legislative powers in the Congress, yet too often the president has violated this fundamental concept though lawless, unilateral executive actions. That must end. 

America is exceptional in that it is the only nation founded on principles, not a territorial or ethnic identity. So long as we stand by the principles enshrined in our Constitution, we will continue to thrive as a nation.

I will not vote for any law that is not constitutionally justified. Protecting the Constitution is not something that can be just left to the Supreme Court to decide. Every branch of government has an equal responsibility to uphold the Constitution. If the Supreme Court or president ever veer off this course, it is the job of Congress to counterbalance them.

Rep. Warren Davidson (R-OH) today introduced the Fair Representation Amendment. This proposed constitutional amendment would end the practice of counting non-citizens for electoral maps. If enacted, the number of representatives and electoral votes per state would reflect citizens rather than total population. Currently, the federal government allocates Congressional seats, as well as Electoral College votes, based on a state’s total number of “persons,” including non-citizens and illegal aliens. As a result, states that refuse to enforce immigration law, and thus have an inflated number of “persons,” are unjustly rewarded with more representatives in Congress and more clout in presidential elections than they would if only citizens were counted.

The resolution would advance the House GOP’s BetterWay agenda by requiring a review of statutes that give the Executive Branch inappropriate lawmaking authority. Anyone who has served in the U.S. armed forces is familiar with completing an Operations Order (OPORD). Spelling out the situation, mission, execution, sustainment, and command and control enables our Army to “fight and win our Nation’s wars.” For our troops in harm’s way in Syria right now, the mission has not been spelled out and Congress, by ignoring its responsibilities to authorize and exercise oversight over the use of military force, is responsible. History has shown us that when Congress neglects its duty, our troops are at an avoidable strategic disadvantage.

WASHINGTON D.C. - Rep. Warren Davidson (R-OH) today cosponsored two amendments (H.J. Res. 6 and  H.J. Res. 50) to the U.S. Constitution imposing term limits on members of Congress. Both amendments would require votes by two-thirds of both chambers of Congress and 38 states to ratify before going into effect.
