ROSEN STATEMENT ON COURT RULING UNDERMINING ACA

WASHINGTON, D.C. - Today, Congresswoman Jacky Rosen (NV-03) released the following statement denouncing a federal judge’s decision in Texas after he ruled the ACA unconstitutional. Rosen applauded House Democratic leaders for signaling plans to potentially bring up her resolution to defend the constitutionality of the ACA in court in the 116th Congress. Rosen’s resolution, which has over 175 co-sponsors, would authorize the Office of the General Counsel of the U.S. House of Representatives to intervene in the federal lawsuit to defend the constitutionality of the ACA’s coverage protections for people with pre-existing conditions.

“We need to do everything possible to protect health care for millions of Americans, especially given this disastrous decision,” said Rosen. “This ruling could jeopardize health care for millions of Americans, including hundreds of thousands of Nevadans with pre-existing conditions. We must fight, now more than ever, to protect our health care. That's why I introduced a resolution to intervene in this court case and am fighting to stop these partisan attacks.”

BACKGROUND: Rosen’s resolution is co-sponsored by the Ranking Members of all House committees of jurisdiction in addition to Democratic Leader Nancy Pelosi and Democratic Whip Steny Hoyer. Senators Joe Manchin (D-WV) and Claire McCaskill (D-MO) introduced a similar Senate resolution to authorize the Senate Legal Counsel to intervene in Texas vs. United States. The Trump Administration announced earlier this year that it would not defend the constitutionality of the ACA in this case, precipitating the need for Rosen’s resolution.
