Congressman Krishnamoorthi: "The Courts Will Ultimately Uphold The Constitutionality Of the Affordable Care Act, And For the Sake Of Millions, They Must"

SCHAUMBURG, IL – Congressman Raja Krishnamoorthi, Ranking Member of the Oversight Committee’s Subcommittee on Health Care, Benefits and Administrative Rules, issued the following statement in response to a district court decision in the Texas v. United States lawsuit striking down the Affordable Care Act, including its essential protections for people with pre-existing conditions:

"Last night's ruling, issued under cover of darkness, imperils the healthcare of more than 20 million Americans while running contrary to both the legislative text and congressional intent of the Affordable Care Act. Despite this temporary setback, I am confident the courts will ultimately uphold the constitutionality of the Affordable Care Act. and for the sake of millions, they must.

This ruling is the result of a lawsuit filed by a radical group of State Attorneys General despite the opposition and denunciation of many of their fellow Republicans. But while their attempt to eliminate the entire Affordable Care Act, and all its protections, was born of partisan political animus and a complete indifference to the millions it would harm, their efforts can be overcome with a single, simple, and bipartisan act of Congress driven by our shared dedication to putting the people we serve first.

I am hopeful that the 116th Congress will quickly pass legislation to guarantee that this misguided ruling cannot be used to deprive millions of Americans of their health care. Now is a time for all Americans to come together and demand Congress pass legislation that protects the healthcare of the millions of Americans with pre-existing conditions.”
