The U.S. Departments of Labor (DOL) and Education (ED) (collectively, Departments) are exercising their transition authority under section 503(a) of the Workforce Innovation and Opportunity Act (WIOA) to inform States that the Departments will consider Program Year (PY) 2016 WIOA Statewide and Local Performance Reports (form ETA-9169) submitted by October 16, 2017, as being timely. For all subsequent PYs, States must submit the WIOA Statewide and Local Performance Report by October 1 to be considered timely, pursuant to the "Workforce Innovation and Opportunity Act (WIOA) Performance Accountability, Information and Reporting System" information collection request (WIOA Joint Performance ICR).

The WIOA Joint Performance ICR, approved under OMB Control Number 1205-0526, contains the performance accountability reporting requirements for the core programs identified in WIOA and authorized under:

  • WIOA title I and administered by DOL;
  • the Adult Education and Family Literacy Act (AEFLA) program, authorized under WIOA title II and administered by ED;
  • the Employment Service program authorized under the Wagner-Peyser Act, as amended by WIOA title III and administered by DOL; and

  Purpose:  

This guidance updates Training and Employment Guidance Letter (TEGL) 10-16 published December 19, 2016 developed jointly by the U.S. Departments of Labor (DOL) and Education (ED) (the Departments). Within ED, the Office of Career, Technical, and Adult Education (OCTAE) and the Rehabilitation Services Administration (RSA) will update Program Memorandum (PM) 17-2 and Technical Assistance Circular (TAC) 17-01 respectively. The updated guidance provides clarifying language and corrections to the operating parameters and to the calculations of the numerators and denominators for the WIOA primary indicators of performance.

The purpose of this guidance is to provide sub-regulatory guidance on the requirements set forth in WIOA, related to the implementation and operation of the performance accountability system under section 116 of WIOA and the implementing joint regulations in 20 CFR part 677 and 34 CFR parts 361 and 463. As explained further in this guidance, WIOA requires all States and direct grantees of the Departments to collect and report information on all the participants described in this TEGL.

WIOA, signed into law on July 22, 2014, is designed to help job seekers access employment, education, training, and support services to succeed in the labor market and to match employers with the skilled workers they need to compete in the global economy. WIOA supersedes titles I and II of the Workforce Investment Act of 1998 (WIA) and amends the Wagner-Peyser Act and the Rehabilitation Act of 1973.

The WIOA Joint Rule for Unified and Combined State Plans, Performance Accountability, and the One-Stop System Joint Provisions (Joint WIOA Final Rule) was published in the Federal Register on August 19, 2016, at 81 FR 55791, and took effect on October 18, 2016. This guidance is based on the statutory requirements of WIOA, as well as its implementing final regulations.

WIOA became law on July 22, 2014 and supersedes Titles I and II of the Workforce Investment Act of 1998 (WIA), and amends the Wagner-Peyser Act and the Rehabilitation Act of 1973. The Departments of Labor and Education published a set of regulations for implementing WIOA. These WIOA Final Rules were made public on July 1, 2016, and the rules covering the Title I youth formula program became effective on October 18, 2016.

WIOA, signed into law on July 22, 2014, supersedes titles I and II of the Workforce Investment Act of 1998 (WIA) and amends the Wagner-Peyser Act of 1933 and the Rehabilitation Act of 1973. In general, WIOA took effect on July 1, 2015, the first full program year after enactment, unless otherwise noted. On August 19, 2016, the Departments of Labor (DOL) and Education published the WIOA Final Rules in the Federal Register. The DOL-only rule became fully effective on October 18, 2016, 60 days after it was published on the Federal Register.

In order to continue implementation of WIOA prior to publication of the final rule, DOL issued a Training and Employment Guidance Letter (TEGL) 3-15, on July 1, 2015, which provided guidance to the public workforce system on delivering services to adults and dislocated workers under WIOA. This TEGL rescinds TEGL 3-15, and provides updated guidance to the public workforce system on service delivery to adults and dislocated workers, consistent with WIOA and the WIOA Final Rules. The section of the final rule pertaining to services for adults and dislocated workers under WIOA title I can be found at 20 CFR part 680 The sections of the final rule pertaining to individuals served under the Wagner-Peyser Act programs, as revised, can be found at 20 CFR parts 651, 652, 653 and 658.
