EEOC Regulations

Regulatory Reform Task Force

Pursuant to Executive Order 13777, the EEOC has established a Regulatory Reform Task Force that will be charged with evaluating existing regulations (as defined in Section 4 of Executive Order 13771) and making recommendations regarding their repeal, replacement, or modification. The Regulatory Reform Task Force will attempt to identify regulations that:

  1. eliminate jobs, or inhibit job creation;
  2. are outdated, unnecessary, or ineffective;
  3. impose costs that exceed benefits;
  4. create a serious inconsistency or otherwise interfere with regulatory reform initiatives and policies;
  5. are inconsistent with the requirements of Section 515 of the Treasury and General Government Appropriations Act, 2001 (44 U.S.C. 3516 note), or the guidance issued pursuant to that provision, in particular those regulations that rely in whole or in part on data, information, or methods that are not publicly available or that are insufficiently transparent to meet the standard for reproducibility; or
  6. derive from or implement Executive Orders or other Presidential directives that have been substantially rescinded or substantially modified.

In performing this task, the Regulatory Reform Task Force welcomes comments from the public regarding the evaluation of existing regulations. Those comments may be submitted to: RegulatoryReformTaskForce@eeoc.gov.

The comments you provide may be made available to members of the Commission and to Commission staff. In addition, your comments may be disclosed to the public. By providing comments in response to this solicitation you are consenting to their use and consideration by the Commission and to their public dissemination. Accordingly, do not include any information in submitted comments that you would not want made public, e.g., home address, telephone number, etc. Also note that when comments are submitted by e-mail, the sender's e-mail address automatically appears on the message.

EEOC regulations implement the federal workplace discrimination laws and are found in the Code of Federal Regulations (CFR). Before the Commission votes to issue a final regulation, EEOC usually first issues a Notice of Proposed Rulemaking (NPRM) for public comment, and sometimes even an Advanced Notice of Proposed Rulemaking (ANPRM) to gather information about the relevant issues. Final regulations, as well as ANPRMs and NPRMS, must be approved by a majority of the Commissioners. In addition, EEOC's significant regulatory actions are approved by the Office of Management and Budget, and are coordinated with other federal agencies.

New and Proposed Regulations


The EEOC has published its semiannual regulatory agenda pursuant to Executive Order 12866, 58 FR 51735, and the Regulatory Flexibility Act, 5 U.S.C. chapter 6. The agenda lists all regulations that are scheduled for review or development during the next 12 months or that have been finalized since the publication of the last agenda. The Annual Regulatory Plan lists the most important regulations under review or development for the next 12 months.

Existing Regulations

EEOC's regulations are published annually in Title 29 of the Code of Federal Regulations (CFR). The CFR is available online through the U.S. Government Printing Office. The links below will connect you with EEOC's regulations in the CFR, which are included in parts 1600 through 1699. Because of the CFR's annual publication schedule, we may link to e-CFR for new or recently amended regulations.
