Amendatory Enactments to the Federal Advisory Committee Act Government in Sunshine Act¹

Be it enacted by the Senate and the House of Representatives of the United States of America in Congress assembled, That this Act may be cited as the 'Government in the Sunshine Act'.

It is hereby declared to be the policy of the United States that the public is entitled to the fullest practicable information regarding the decisionmaking processes of the Federal Government. It is the purpose of this Act (see Short Title note set out above) to provide the public with such information while protecting the rights of individuals and the ability of the Government to carry out its responsibilities.

Sec. 5 Conforming Amendments.

(c) Subsection (d) of section 10 of the Federal Advisory Committee Act is amended by striking out the first sentence and inserting in lieu thereof the following: "Subsections (a)(1) and (a)(3) of this section shall not apply to any portion of any advisory committee meeting where the President, or the head of an agency to which the advisory committee reports, determines that such portion of such meeting may be closed to the public in accordance with subsection (c) of section 552b of title 5, United States Code.

Sec. 6 Effective Date.

(a) Except as provided in subsection (b) of this section, the provisions of this Act (see Short Title note set out below) shall take effect 180 days after the date of its enactment.

(b) Subsection (g) of section 552b of title 5, United States Code, as added by section 3(a) of this Act, shall take effect upon enactment.
