How OGC or OJAG is determined to be the cognizant appellate authority for a particular FOIA appeal is determined by whether the subject matter of the appeal falls within the following assignment of responsibilites:
OGC's cognizance
includes: Business and commercial law aspects of acquisition; military sealift; civilian personnel; comptroller; information systems; intellectual property; foreign military sales; and environmental matters.
OJAG's cognizance
includes in addition to military matters, all matters except those falling under OGC.
Appellate Authority within OGC
Although there have been delegations of authority to the Principal Deputy General Counsel and the Deputy General Counsel, currently the Deputy General Counsel decides most FOIA appeals within the cognizance of the General Counsel.
Appellate Authority within OJAG
Though there have been delegations of authority to the Assistant Judge Advocate General (Civil Law), the Principal Deputy Assistant Judge Advocate General, and the Deputy Assistant Judge Advocate General (General Litigation Division), presently the Deputy Assistant Judge Advocate General (General Litigation Division) decides most FOIA appeals under the cognizance of the Judge Advocate General.
