ADR HELPS FIGHT THE WAR ON TERRORISM

The terrorist attacks against our nation have required us to refocus our resources," and "ADR is making a significant contribution to that effort," according to Attorney General John Ashcroft. In a letter to the Interagency ADR Steering Committee, the Attorney General encouraged the continued use of ADR "as an effective mechanism to maximize our resources and further our goal of good government." If you would like to maximize your command's resources by using ADR, please contact the DON ADR Program.

TASK AND DELIVERY ORDER OMBUDSMAN COURSE

FAR 16.505(b)(5) and NMCARS 5216.505 require a designated multiple award task order contract and delivery order contract ombudsman to review contractor complaints. The DON ADR Program will offer a Task and Delivery Order Ombudsman course on JUNE 29, 2004 at the Washington Navy Yard. NEBRASKA AND ILLINOIS ADOPT UMA

The Uniform Mediation Act (UMA) has been passed in Nebraska and Illinois. See the full texts of the Illinois Act and the Nebraska Act.

ATTORNEY GENERAL ENDORSES ADR:

On May 18, 2002, Attorney General John Ashcroft endorsed alternative dispute resolution (ADR) methods as integral parts of the American system of justice because they allow parties to resolve disputes themselves. "Our system of justice balances contention with consensus because, in the marketplace of justice, a monopoly on litigation serves to alienate the people from the law - and distances the legal profession from those it serves," stated Ashcroft. He touted the Department of Justice's (DOJ) record of using ADR by giving specific examples of ADR in a volatile civil rights matter in Cincinnati and the use of streamlined compensation procedures to access the September 11 Victim's Compensation Fund. He indicated that the DOJ's use of ADR techniques has dramatically risen from 550 cases in 1995 to 3000 cases in 2002. The Attorney General quoted Abraham Lincoln's admonition that, "As a peacemaker, the lawyer has a superior opportunity to be a good man. There will be business enough." Full text of AG speech
