The following information is provided in furtherance of the Navy's objective of supporting the use of Alternative Dispute Resolution methods to resolve conflicts.


IADRWG CONTRACTS AND PROCUREMENT SECTION & THE ABA PRESENT:
"MEDIATION STYLES AND TECHNIQUES"


The program will provide participants with concise explanations of each of the various mediation styles (evaluative, facilitative, transformative, narrative, etc.) and examples of how each style is used best, including examples of how styles may be combined. We also plan to conduct a demonstration session where a hypothetical sample case study will be used by the panelists with participation of members of the live audience, to illustrate how the different mediation styles and techniques can be used to approach a problem in order to achieve an amicable, mediated solution.

DEFENSE ACQUISITION UNIVERSITY ACQUISITION & CONTRACTS WORKSHOP

The workshop is presented in a “hands-on” exercise and case study environment. The participants will be introduced to the benefits of early disputes resolution and given opportunities to practice problem-solving using ADR techniques in reaching collaborative agreements that are beneficial and improve contractual outcomes—win-win relationships.

    DEFENSE ACQUISITION UNIVERSITY ADR COURSE DESCRIPTION

    Issues in controversy develop and evolve during the life of a contract from pre-award throughout closeout. Issues that remain unresolved often end up in litigation before the Federal Courts and Administrative Boards. Litigation can be timely, costly, and counterproductive to an organization’s mission. In addition, litigation often does not consider or promote the on-going, working relationship of the parties to a contract. Though the issue in controversy may be settled through litigation, adversarial relationships that contribute to a “them vs. us” attitude are normal outcomes. The focus of this course is early disputes resolution using Alternative Disputes Resolution (ADR) concepts and techniques.

    The Administrative Disputes Resolution Act, Executive Orders, federal regulations, and directives provide alternative means of resolving contentious issues. ADR can lead to mutual agreements that are equitable, cost effective, and time efficient while building positive working relationships that continue beyond the life of the contact.

    ADR consists of various collaborative methodologies which include partnering, interest-based negotiation, and third party assisted processes, such as mediation.

    We have designed an intensive two-day workshop that focuses on creating an environment conducive to early conflict resolution.

    The workshop addresses:

    • Introduction to ADR concepts and importance
    • Interest-based negotiation
    • Partnering
    • Third-party assisted ADR procedures
    • ASBCA/GAO/Federal Court ADR procedures
