Q: What is the Excluded Parties Lists System (EPLS)?
A: EPLS is the electronic version of the Lists of
Parties Excluded from Federal Procurement and Nonprocurement Programs (Lists),
which identifies those parties excluded throughout the U.S. Government (unless
otherwise noted) from receiving Federal contracts or certain subcontracts and
from certain types of Federal financial and nonfinancial assistance and benefits.
Q : How do I confirm or obtain more information on a listed individual/firm?
A: For additional information regarding an
excluded party, please call the appropriate agency contact person. To find the appropriate agency, refer
to the record found on the EPLS. Agency points of
contact are listed under "View Agency Contacts".
Q: What is the difference between reciprocal, procurement, and nonprocurement
A: There are three (3) Exclusion Types: reciprocal, procurement and nonprocurement:
The Reciprocal Lists, is a
listing of procurement and nonprocurement exclusions taken after August
25, 1995. The Federal Register on June 26, 1995, published the final rule to
ensure that exclusions from Government procurement and nonprocurement programs
were applied reciprocally. The effective date of this change was August 25,
1995. In other words, any procurement or nonprocurement action initiated on or
after August 25, 1995, means exclusion from both programs. This list includes
individuals, entities, and contractors that are excluded Governmentwide (unless
otherwise noted) from Federal procurement sales programs, nonprocurement
programs, and financial and nonfinancial benefits.
The Procurement List, is a
listing of procurement exclusions only. All exclusions in this section
were added before August 25, 1995. Currently, only updates and deletions are
being performed on this section and it will eventually diminish and no longer
appear. This list includes contractors that are excluded governmentwide,
unless otherwise noted, from Federal procurement and/or sales programs.
The Nonprocurement List, is a
listing of nonprocurement exclusions only. All exclusions in this
section were added before August 25, 1995. Currently, only updates and
deletions are being performed on this section and it will eventually diminish
and no longer appear. This list includes persons (individuals and entities)
excluded govermentwide, unless otherwise noted, from certain types of Federal
financial and nonfinancial assistance and benefits.
Q: How do I obtain a copy or subscription to the Lists of Parties Excluded
from Federal Procurement or Nonprocurement Program (Lists), the monthly hardcopy?
A:
The monthly hardcopy of the List of Parties Excluded from Federal Procurement
and Nonprocurement Programs (Lists) has been discontinued and is no longer
being published. The last printed copy is dated July 11, 2003.
The Excluded Parties List System (EPLS) is the electronic version of the Lists.
Q: Do I have to check all three exclusion types
(reciprocal, procurement, nonprocurement)?
A: The three exclusion types are separate and distinct.
Users should therefore download the Reciprocal List and the appropriate
Procurement or Nonprocurement List. However, when searches are performed
under the search menu (current exclusions) or the archive menu (past
exclusions) the entire database is searched.
Q: Is this the same list as the OIG List, Echo System, LDP, etc?
A: GSA's EPLS and the Lists of Parties Excluded from
Federal Procurement and Nonprocurement Programs are separate from any other
listing. GSA is required by the Federal Acquisition Regulation (FAR) to
compile and maintain a list of parties debarred, suspended, proposed for
debarment, or declared ineligible by agencies or by the General Accounting
Office.
Q: What is an SDN?
A:
As part of its enforcement efforts, the U.S. Treasury Department, Office of
Foreign Assets Control (OFAC) publishes a list of individuals
and companies owned or controlled by, or acting for or on behalf of,
targeted countries. It also lists individuals, groups, and entities,
such as terrorists and narcotics traffickers designated under programs
that are not country-specific. Collectively, such individuals and
companies are called "Specially Designated Nationals" or "SDNs."
Their assets are blocked and U.S. persons are generally prohibited
from dealing with them.
Q: What do I do if I have a match to the SDN list?
A:
If you have checked a name manually or by using software and find a match,
you should do a little more research. Is it an exact name match, or very
close? Is your customer located in the same general area as the SDN? If not,
it may be a "false hit." If there are many similarities, contact the Office of
Foreign Assets Control (OFAC) "hotline"
at 1-800-540-6322 for verification. Unless a transaction involves an exact match,
it is recommended that you contact OFAC Compliance before actually blocking assets.
Q: What is the Control list? Who do I call about the Control list?
What is the difference between the Control list and OFAC's SDN list?
A:
The Control List was developed by the law enforcement community in response to
the events of September 11. It is separate from the OFAC's SDN list and is not
disseminated by OFAC. If you have received a copy of this list, you should follow
the instructions received with it.
Q: What is a Denied Persons List?
A:
The purpose of 'The Denied Persons List' to prevent the illegal export
of dual-use items before they occur;
investigate and assist in the prosecution of violators of
the Export Administration Regulations (EAR) and
the Fastener Quality Act (FQA);
and inform and educate exporters, freight forwarders, and manufacturers
of their enforcement responsibilities under the EAR and FQA.
The list is created by U.S. Bureau of Industry and Security
as part of BIS's Export Enforcement (EE) program
Q: What is an Entity List?
A:
The Entity List contains a list of foreign end users involved in proliferation activities
and informes the public of export license requirements related to these entities.
The listing is based on the Enhanced Proliferation Control Initiative (EPCI), which
has been implemented in the Export Administration Regulations, and has been created by
U.S. Bureau of Industry and Security.
While this list will assist exporters in determining whether an entity poses proliferation
concerns, it is not comprehensive. It does not relieve exporters of the responsibility
to determine the nature and activities of their potential customers.
Q: How often is EPLS updated?
A: EPLS current exclusions and past exclusions available
from the search menus are updated in real time as changes to the list are required.
Records available through the reports menu are updated nightly.
Q: How do I find out
about an individual/firm that was convicted or plead guilty but is not on EPLS?
A: If an individual/firm is not listed, GSA has not
been notified of the action. The action could be in route to GSA. If you have
checked EPLS and found the name not listed, you have checked the most current
information available. GSA does not have access to additional information.
Q: How do I obtain information
on an exclusion that has been removed from the list?
A: Past exclusions can be obtained by searching the
archived menu.
Q: What is a cross-reference and a primary record type?
A: When more than one name and/or company is involved
in a single action they are linked by making one the primary and the others
cross-references. A primary will give you a list of cross-references (others
involved in the same action) and a cross-reference will list the primary only.
If you need to know all the parties involved in a single action you should
refer to the primary.
Q: What is a Cause and Treatment (CT) Code and how do I apply it to the entry?
A: The treatment to be accorded to a party listed
depends on the type of exclusionary action taken and the authority under which
the action was taken. Therefore, the cause for the exclusion and the treatment
of the party excluded are noted by a CT Code. All codes are explained under
"View Cause and Treatment Codes".
Q: What is an Action Date and Termination Date?
A: The action date is the effective date of the
exclusion and the termination date is the date the action terminates.
Q: What is an Archive Date?
A: The archive date is the date that the record was removed
from the system manually or by its termination date.
Q: What is the function of the Reports Menu?
A: Reports are downloads of selected exclusion types:
reciprocal, procurement, nonprocurement and procurement/nonprocurment. The
procurement/nonprocurement exclusion type is a combination of both the
procurement and the nonprocurement exclusion types combined to reduce the number
of program downloads. There are (4) Exclusion Types and (7) Report Options.
Lists Report:
a complete listing of current excluded parties for the exclusion type selected;
Supplemental Report:
a listing of current excluded parties added,
modified or deleted for a specific timeframe for the exclusion type selected;
Agency Report:
a listing of current excluded parties taken by a
particular agency for the exclusion type selected;
State/Country Report:
a listing of current excluded parties in a
particular state for the exclusion type selected;
Lists Date Report:
a complete listing of current excluded parties for
the exclusion type selected with fields delimited by special characters;
Supplemental Data Report: a listing of current excluded parties added,
modified or deleted for a specific timeframe for the exclusion type selected
with fields delimited by special characters;
Cause and Treatment Code(CT):
a listing of current excluded
parties by a particular CT Code for the exclusion type selected;
Q: What is the function of the Search Menu?
A: Searches the entire database of current exclusions
simultaneously for the search option selected. You do not have to select an
exclusion type. There are (8) search options:
Name: searches for an exclusion of a particular name by
partial name or exact name. The partial name search performs a search on one
word only. Therefore, you would use the individuals last name or the first
word of the firm's name. The exact name search searches for the name exactly
as entered.
Multiple Name: searches for multiple names simultaneously.
Performs the same as the search by name option;
DUNS: searches for all current exclusions under the CT code specified;
Agency: searches for all current exclusions taken by the agency specified;
State: searches for all current exclusions in the state or country specified;
Action Date: searches for all current exclusions taken effect on
the specified date; Action date is defined as the effective date of the
current action in the system. (format - dd-mm-yyyy).
Termination Date: searches for all exclusions terminating on the specified date.
Termination date is defined
as the date the actions were removed from the system automatically (because the
termination date expired) or removed manually by the agency. (format - dd-mon-yyyy).
Exact Name and SSN/TIN: searches for a current exclusion that matches by
exact name and SSN/TIN. (Exact Name and SSN/TIN must be in system to receive a
matching criteria; therefore this may not be the optimal way to determine if an
entity is excluded)
Q: What is function of the Archive Menu?
A: Searches for archived record. There are (2) archive search options.
Name: Searches for an archived record (past exclusion) by the exact name
or all archived records (past exclusions) with the partial name specified.
Multiple Name:Searches for at least (5)
archived records (past exclusions) by the exact name or all archived records
(past exclusions) with the partial name specified simultaneously.
