THE AUTHORITY INVITES COMMENTS ON
UNFAIR LABOR PRACTICE PROCEEDINGS

The Federal Labor Relations Authority is requesting customer input through amici curiae briefs on a series of specific questions arising in a group of cases currently pending before the Authority. On November 17, the Authority issued a Partial Decision and Procedural Order in U.S. Department of Commerce, Patent and Trademark Office, Case No. WA-CA-40743, which decides certain issues, directs the parties to file briefs to address questions contained in the decision, and invites the parties to request oral argument on these issues. The parties in Department of the Air Force, 647th Air Base Group, Hanscom Air Force Base, Massachusetts, Case No. BN-CA-41011; U.S. Department of Justice, Immigration and Naturalization Service, Case No. WA-CA-50048; Social Security Administration, Santa Rosa District Office, Santa Rosa, California, Case No. SF-CA-50155; and U.S. Department of Veterans Affairs Medical Center, Lexington, Kentucky, Case No. CH-CA-50399 are also directed to respond to the questions described in the decision.

This group of pending cases requires the Authority to adjudicate unfair labor practice complaints and resolve whether section 2(d) of Executive Order 12871 constitutes an agency election to bargain on section 7106(b)(1) matters -- so called "permissive subjects" -- that can be enforced by the Authority and reviewed in subsequent court proceedings.

Anyone interested in providing comments is asked to answer a series of specific questions which are set out in a "Notice of Opportunity to Submit Amici Curiae Briefs" appearing in today's Federal Register.
