NEW BROCHURE FOR FACILITATION SERVICES
With an eye towards January, 05, the DON ADR Program plans to offer trained meeting facilitators available through the ADR Coordinators at your HRSC. See our new brochure!
IADRWG CONTRACTS AND PROCUREMENT SECTION & THE ABA PRESENT:
"MEDIATION STYLES AND TECHNIQUES"
The program will provide participants with concise explanations of each of the various mediation styles (evaluative, facilitative, transformative, narrative, etc.) and examples of how each style is used best, including examples of how styles may be combined. We also plan to conduct a demonstration session where a hypothetical sample case study will be used by the panelists with participation of members of the live audience, to illustrate how the different mediation styles and techniques can be used to approach a problem in order to achieve an amicable, mediated solution.

The Washington Navy Yard Series: Representation at the Mediation Table
November 18, 2004, from 9:30 a.m. to 2:30 p.m.
This presentation will focus on the skills needed to effectively represent a party at a mediation session. The target audience is all persons who represent parties at a mediation including both management and employee representatives. The course will include discussions on the importance of preparation for the mediation session, and effective communication during the mediation session.
While there is some lecture, we encourage all attendees to participate in discussion of effective techniques that have helped attendees achieve success in real world situations, so bring your best war stories.
Specific topics include:
- The importance of all aspects of the preparation required for success
- The importance of communicating with the party represented
- The importance of preparing a concise statement of the party's position
- Evaluating expectations and understanding acceptable outcomes
- Educating the represented party regarding the mediation process
- Determining the roles of the representative and party at the mediation

DON WORKPLACE ADR FACILITATION PROGRAM SEPTEMBER 30, 2004 APPLICATION EXTENSION
The Department of Navy's (DON) Workplace Alternative Dispute Resolution Program extends its application deadline through September 30, 2004 to continue accepting applicants for training as collateral duty facilitators. These facilitators will provide facilitation services in large and small meetings covering a wide range of topics involving Navy civilian employees. Applicants must be current DON civilian employees, and have their supervisor's permission to apply and participate. Criteria for selection include experience in public speaking, active listeneing, managing meetings, dealing with conflict, conducting training, and the ability to act in a neutral, ethical and impartial manner. Alternative Dispute Resolution experience is beneficial but not required. This program hopes to attract a diverse group of applicants from all areas of Navy Marine Corps life. Participants in the Navy Certified Mediator Program are particulary encouraged to apply. Training in the art of facilitation will be arranged by most Human Resource Service Centers. The DON ADR Program will provide this no cost training. Travel, if necessary, will be funded by the applicant's activity. Navy employees interested in becoming facilitators are requested to submit an application by September 30, 2004. The application form is here. Completed applications should be submitted to:

If your facilitator application has been received by OCHR you have been contacted via e-mail. Upon successful completion of the training course, facilitators will receive a certificate and become a member of a cadre of DON facilitators. These trained facilitators will be available to provide facilitation services in the future, please check this website for updates.
DASN (CHR) & DRS ENCOURAGE WORKPLACE MEDIATION
The DON policy to use ADR "to the maximum extent practicable" applies to all types of civilian workplace disputes, according to a recent memo signed by
Thomas F. Kranz, Principle Deputy General Counsel & DON Dispute Resoulution Specialist, and Patricia Adams, Deputy Assistant Secretary of the Navy (Civilian Human Resources). They encourage employees to use
"I Need a Mediator!" to arrange for mediation by a qualified, DON certified mediator.

Alternative Dispute Resolution - Innovative Conflict Management
Many organizations today are emphasizing the use of consensual methods of dispute resolution instead of using litigation or administrative procedures. This course explores a variety of alternative dispute resolution (ADR) techniques and current dispute applications. Participants actively engage in a series of workgroup exercises using real-world dispute scenarios. A variety of innovative conflict resolution techniques and methods are proposed, evaluated, and put into practice. Specific emphasis is placed on the effective use of alternate methods of resolving disputes in the workplace, presentations before third parties, and conflicts that develop between parties to a contract. ETHICS FOR ATTORNEYS – YOUR DUTY TO ADVISE CLIENTS OF ADR
As you might be aware, the ABA recently amended the official comments to Model Rules of Professional Conduct. Specifically, Comment 5 to Rule 2.1 now states, “It may be necessary under Rule 1.4 to inform the client of forms of dispute resolution that might constitute reasonable alternatives to litigation.” What does this mean for your legal practice? DON-USIECR PARTNERSHIP - GET ENVIRONMENTAL MEDIATION OR FACILITATION FAST
The United States Institute for Environmental Conflict Resolution (USIECR), a small federal agency, helps other federal agencies and interested parties resolve environmental, natural resource and public lands conflicts. The DON successfully used the institute's services in the past (see http://adr.navy.mil/adr/AnacostiaMediation.doc ), and the DON ADR Program is please to announce a new interagency agreement that will allow Navy and Marine Corps activities to get a high quality mediator or facilitator FAST. The agreement also provides training and case assessment services. Since DON ADR Program has partially FUNDED the agreement, the institute can get to work on your project immediately!
