Hurricane Charley

Office of Personnel Management (OPM) Issues Guidance on Hurricane Charley

      The Office of Personnel Management (OPM) has issued a memorandum with guidance on available actions for agencies who have employees affected by Hurricane Charley. Hurricane Charley damaged property and caused major electric power outages. Official estimates predict lengthy recovery time in areas with significant damage. OPM's August 13, 2004, memorandum encouraged the granting of excused absence (absence from work without charge to leave or loss of pay) for affected Federal employees. DoD guidance permits commanders and heads of activities to close all or part of an activity and to excuse affected employees under these unanticipated conditions for up to 3 consecutive workdays. For more than 3 consecutive workdays, they may excuse employees who are prevented from returning to work because of the installation situation, after considering and documenting other options such as details to other activities, the use of unscheduled leave, and furlough. Additionally, based on the OPM memorandum, we authorized waiver of the bi-weekly pay cap on overtime for those employees engaged in emergency work directly associated with Hurricane Charley. These employees will continue to be subject to the annual pay cap. More information on these issues is available in the August 13 memorandum, which also discusses other available flexibilities. Hurricane Frances

      Reference the Office of Personnel Management (OPM) Memorandum, CPM 2004-16, dated September 2, 2004, subject: Hurricane Frances. The memorandum is on OPM's website at http://www.opm.gov/oca/compmemo/2004/2004-16.asp. In this memo, OPM encourages agencies to grant excused absence to Federal employees who are affected by Hurricane Frances, and to those employees who are requested to assist in authorized emergency law enforcement, relief, and clean-up efforts in affected communities. We fully support OPM's guidance.

Commanders and heads of activities with appointing authorities have the authority necessary to use the flexibilities discussed in the OPM memorandum to meet the emergency needs of affected employees. DoD 1400.25-M, Subchapter 610, Section SC610.3 2.2. covers situations in which a commander or head of an activity may use his or her authority to close all or part of an activity and, consistent with that closure, administratively excuse the non-emergency essential DoD civilian workforce. Section SC610.3.3.3. outlines documentation requirements for group dismissal beyond 3 consecutive days.

Commanders and heads of activities with appointing authority may grant waivers to the biweekly cap on premium pay to employees performing emergency overtime work in association with the aftermath of Hurricane Frances based on their determination that an emergency exists. The annual premium pay limitation will apply. See attached OPM memorandum for specific information on premium pay.

Hurricane Ivan

Reference the Office of Personnel Management (OPM) Memorandum, CPM 2004-17, dated September 10, 2004, subject: Hurricane Ivan. The memorandum is on OPM's website at http://www.opm.gov/oca/compmemo/2004/2004-17.asp. Consistent with previous guidance concerning natural disaster, OPM encourages agencies grant excused absence to Federal employees who are affected by Hurricane Ivan, and to those employees who are requested to assist in emergency law enforcement, relief, and clean-up efforts in affected communities authorized by appropriate officials. We continue to fully support OPM's guidance as we had done during hurricanes Charley and Frances.
