Legal Opinion Letters

The Office of General Counsel (OGC) provides NCUA with legal advice and opinions on matters of law.  It also provides the public with interpretations of the Federal Credit Union Act, NCUA regulations, and other NCUA Board directives.  This section of the website contains legal opinions issued to the public by OGC since 1991, organized by year.  You can identify opinion letters by their individually assigned numbers and subject headings.  You can also use the website’s search function to retrieve opinion letters by topic.  A few of the letters are outdated or have been superceded by subsequent opinions and changes in the law but are included because they may be helpful for historical research.

This website offers many resources for credit unions and the public when they have questions about the Federal Credit Union Act and NCUA Rules and Regulations, such as NCUA Interpretive Rulings and Policy Statements, Letters to Credit Unions, Regulatory Alerts and OGC Opinions.  Agency decisions on appeals under the Freedom of Information Act are located in the section of this website devoted to FOIA.  This website also contains OGC opinions on nonstandard bylaw amendments in the Federal Credit Union Bylaws section.

If you have a legal question that is not addressed in any of the guidance listed above, you may request assistance from OGC.  You may call OGC at (703) 518-6540 or send an e-mail to ogcmail@ncua.gov.  If you send an e-mail, please include a daytime telephone number.  You may also request a written legal opinion from OGC.  OGC will respond to your request in writing if your request involves a new or substantial question of law or policy and you have provided sufficient information and analysis regarding the issue you want OGC to address.
