and procedures for DTRA implementation of the Freedom of
Information Act (5 U.S.C. 522, as amended) and Department
Of Defense (DOD) Regulation 5400.7-R. This Instruction supplements
DOD 5400.7-R to accommodate the specific requirements of
the Agency's FOIA program.

administration of the FOIA Program within DOD.
Annual Freedom of Information Act Program
Reports. As a component of DOD, DTRA submits report
information, which is compiled into their Annual
Reports to Congress:

Reading Room. An appropriate facility
where the public may inspect and copy, or have copied,
the reading room records described in DOD Regulation
5400.7-R, will be made available upon request. Please

How to Submit a FOIA Request to DTRA
FOIA requests may be submitted by mail, facsimile
or electronically. Requests should be submitted

Costs and fees. Persons requesting
records from DTRA will be charged fees as stated
in DOD 5400.7-R. As stated in this Regulation, the
requester will be categorized as either:

Commercial
- Pay all search, review, and duplication
|
|
Educational
or Noncommercial Scientific Institution or
News Media - Pay duplication charges
only in excess of 100 pages.

|
Others - Pay search and duplication
fees in excess of 2 hours Search and 100 pages |
Established DOD fees are; clerical search and review
@ $20 per hour; professional search and review @
$44 per hour; computer search varies according the
system used; microfiche @ 0.25 per page; and reproduction
cost @ 0.15 per page.
It is DOD policy to waive all assessable fees if
the total amount does not exceed $15.
If you intend to ask for a fee waiver, your request
should describe how the disclosure of the information
is in the public interest and explain how you will
disseminate this information.
