The one-count indictment alleges that Porter possessed .40 caliber ammunition on June 26, 2004, in Janesville. If convicted, Porter faces a maximum penalty of ten years in prison, a $250,000 fine, and a three-year period of supervised release.

The charge against Porter is the result of an investigation conducted by the Janesville Police Department and the Bureau of Alcohol, Tobacco, Firearms and Explosives. Prosecution of this case has been assigned to Assistant United States Attorney Rita M. Rumbelow.
