Businesses: Report a Potentially Defective or Hazardous Product

Office of Compliance - Section 15(b) Internet Report


This form is for use by businesses only to report a potentially hazardous product that they manufacture, distribute, import, or sell. Consumers: please do not use this form - use the form under "For consumers".

Manufacturers, importers, distributors, and retailers are required to report to CPSC under Section 15 (b) of the Consumer Product Safety Act (CPSA) within 24 hours of obtaining information which reasonably supports the conclusion that a product does not comply with a safety rule issued under the CPSA, or contains a defect which could create a substantial risk of injury to the public or presents an unreasonable risk of serious injury or death, 15 U.S.C. § 2064(b). The Recall Handbook will familiarize companies with their reporting requirements. The Commission's interpretive regulation Substantial Product Hazard Reports, 16 C.F.R. Part 1115 explains the company's obligations and the Commission's procedures.

By filling out the form below (with as much information as possible) and then submitting it, you can file an initial report about a potentially defective or hazardous product. The Commission often receives requests for information provided by firms under Section 15 (b) of the CPSA. Section 6 (b)(5) of the CPSA, 15 U.S.C.§2055(b)(5) prohibits the release of such information unless a remedial action plan has been accepted in writing, a complaint has been issued or a firm consents to the release. The Commission is prohibited from disclosing trade secret or confidential commercial or financial information. 15 U.S. C. § 2055(a)(4). Firms submitting information considered to be trade secret, confidential commercial or financial, must mark it "confidential" in accordance with section 6 (a)(3) of the CPSA, 15 U.S.C. §2055(a)(3) and 16 C.F.R. §1015.18.

The following report is "Confidential" in accordance with the above sections.


The "Fast Track Product Recall Program" (pdf format) is an alternative procedure for recalling products reported upon under Section 15(b) of the CPSA. 62 Fed. Reg. 39,827 (7/24/97). Under this program, if a company reports under Section 15(b) and implements within 20 working days after filing its initial report a corrective action that the staff believes will be effective, the staff will not make a preliminary determination that the product presents a substantial product hazard.
