    COMMUNITY DEVELOPMENT

    NEWSLETTER

    Community Developments newsletter. The newsletter shares information on timely community development issues pertinent to financial institutions, major Federal initiatives, and regulatory policies approved by the OCC. It provides timely information about innovative national bank lending and investing practices that are effective and beneficial to communities. It is published quarterly. The subscription is free.

    • Fall 2004 "The Power of Plastic: How Banks are Using Technology to Reach the Unbanked," focuses on how depository institutions are using stored value cards, the Internet, and other technology-driven products to provide financial services to the 10 million unbanked households in the United States.

    • Summer 2004 "New Markets Tax Credits -- Bridging Financing Gaps" focuses on how banks are leveraging these tax credits to revitalize economically distressed communities.

    • Winter 2003 "Strengthening America: The Small Business Advantage" looks at what banks and other financial institutions are doing to support small businesses.

    Effective Strategies For Community Development Finance/Community Development Resource Guide(2000). This is a two-volume set that provides information on practices that have helped selected national banks engage in commumity development finance, as well as a listing of approximately 145 resources to assist bankers and their community partners in obtaining information about community development programs and tools.

    Community Development: A Profitable Marketing Opportunity (1997). This publication features papers from a diverse group of experts in community development lending and investing. The information is offered to encourage readers to continue this work and these initiatives, and to promote additional activities and interest in community development finance.     Community Development Finance: Tools and Techniques for National Banks (1996). This publication describes many of the financing methods used by banks and other financial institutions to help facilitate economic development and community revitalization. This is a resource guide for national banks and others seeking information on how to expand CD lending. (Available Only in Print.)

    Native American Resource Directory . This directory provides descriptions and contact information for a sampling of organizations that can offer resources to banks interested in lending, investing, or providing retail financial services in Indian country. These activities are organized under the following categories:

    Providing Financial Services to Native Americans in Indian Country (1997). This booklet provides examples of how several banks provide financial services in Indian Country.

    A Guide to Mortgage Lending in Indian Country (2002). This guide presents some of the issues involved in mortgage lending in Indian Country. It discusses such topics as Indian lands, trust lands, tribal sovereignty, and civil jurisdiction. A list of government resources is also included.

    A Guide To Tribal Ownership of A National Bank(2002) This guide is intended to assist federally recognized Indian tribes in exploring entry into the national banking system by establishing or acquiring control of a national bank.

    COMMUNITY DEVELOPMENT (CD) BANKS

    Guidance to Prospective Community Development Bank Organizing Groups (2001). This OCC memo provides a general discussion of the chartering process for community development national banks, including the licensing and operational issues facing bank organizers. It also outlines the criteria the OCC uses in granting a CD bank charter, explains the assistance OCC provides to organizers of CD banks, and states the factors the OCC considers to be critical to the success of any de novo CD bank.

    Guide To Tribal Ownership of a National Bank (2002). This guide was developed to assist federally recognized Indian tribes in exploring entry into the national banking system by establishing or acquiring control of a national bank. The publication provides a high level overview of the process of chartering a national bank and may also be useful to individuals and groups considering the formation of a Community Development Bank.

    Community Development Corporations, Community Development Projects, and Other Public Welfare Investments Regulation (2003). This rule (12 CFR Part 24) governs national bank investments designed to promote the public welfare. National banks may make investments in Community Development Banks under the provisions outlined in the regulation.

    SINGLE-FAMILY AND MULTI-FAMILY AFFORDABLE HOUSING

    The Single-Family Affordable Housing Market: Trends and Innovations . This publication captures the presentations given at the July 1997 Affordable Housing Symposium sponsored by the OCC. Topics include the state of the affordable mortgage lending market, affordable mortgage underwriting standards, risk management, risk mitigation strategies, and the future of this segment of the housing industry. The 104-page publication has insights for banks with a long history of affordable housing lending, as well as for those with an eager interest in this expanding market.

    PART 24 COMMUNITY DEVELOPMENT INVESTMENTS

    National banks may make investments primarily designed to promote the public welfare under the community development investment authority in 12 USC 24 (Eleventh) and its implementing regulation, 12 CFR 24 (Part 24). This authority allows banks to make investments that primarily benefit low- and moderate-income individuals, low- and moderate-income areas, or areas targeted for redevelopment by local, state, tribal, or federal government.

    CD-1 - National Bank Community Development (Part 24) Investments The OCC recently revised its form CD-1 - National Bank Community Development (Part 24) Investments form to be consistent with the final changes to 12 CFR Part 24, which were effective on September 15, 2003. The new form continues to use a check-list format that provides step-by-step guidance to national banks that submit information to the OCC about their Part 24 investments. A bank must submit the completed CD-1 form to provide either an after-the-fact notice or to request prior OCC approval of a community development investment under Part 24. The bank should send the completed CD-1 form to the Director, Community Development Division, Mail Stop 7-3, Office of the Comptroller of the Currency, Washington, DC 20219. The revised Part 24 regulation, the availability of the CD-1 form, and the effective date are described in Bulletin 2003-39. A Word version of the CD-1 form is also available which allows the user to either print or download the form. The CD-1 form is Section 508 compliant.     Quick Reference Guide to Part 24 Investments  describes the guidelines for community development investments covered by 12 CFR 24. It gives an easy-to-follow list of requirements and examples of how banks make investments.

    Directory of 2002 National Bank Community Development Investments discusses recent trends in national bank community development investments and provides brief summaries of Part 24 investments made by national banks and their community development partners in 2002. It also provides a summary listing of national and regional funds in which banks invested in 2002 and geographic listings of investments with contact information. The 2001, 2000, 1999, 1998, 1997 editions of the directory are available on-line. Please contact the Community Development Division if you would like to obtain the 1994, 1995 or 1996 editions.

    Community and Economic Development Entities, Community Development Projects, and Other Public Welfare Investments   The OCC has amended 12 CFR part 24, which describes its rules governing public welfare investments by national banks. The amended rule was published in the Federal Register on August 15, 2003 and is effective on September 15, 2003 (see Bulletin 2003-39). These changes are intended to encourage new and expanded investments by national banks supporting community and economic development efforts and include:

    • Updating the definition section of the regulation to reflect the additional types of public welfare investment structures that have become more common in recent years and that are permissible under the governing statute.
    • Adding a new option to the public welfare standard by permitting an investment that would receive consideration under CRA as a "qualified investment."
    • Clarifying how a national bank calculates the value of its public welfare investments for purposes of complying with the rule's investment limits.
    • Expanding the list of examples of qualifying public welfare investments that satisfy the rule's requirements.

    Focus on Part 24 Community Development Investments - This edition of the Community Developments newsletter looks at examples of bank investments undertaken pursuant to the Part 24 community development investment authority. The newsletter also outlines the differences in the criteria for a community development investment under CRA versus Part 24. Community development investment case studies include:
