This regulation, published in the Federal Register on June 24, 1992 (57 FR 28103) amends Federal regulations at 45 CFR 303.70, providing for requests by the State parent locator service for information from the Federal Parent Locator Service (FPLS). The regulation requires reimbursement from the States for the use of the FPLS for cases in which there is no required assignment of support rights to the State.

This action transmittal: (1) provides States with information on the use of the Federal PLS in child custody and parental kidnapping cases, (2) prescribes specific procedures for using the Federal PLS in connection with such cases, and (3) contains an advance copy of the agreement for use of the Federal PLS in parental kidnapping and child custody cases. The content of this action transmittal is based on draft regulations which are in the Department`s clearance process. States should note that the provisions of this action transmittal are subject to change upon publication of final regulations in the Federal Register.

The Federal Parent Locator Service provides to State IV-D Agencies, address information obtained from various Federal agencies. The information obtained frown the Internal Revenue Service and the Social Security Administration is considered tax information. lt is imperative that all State and local jurisdictions who use this data be aware of the need to safeguard confidential Federal tax data and be advised that failure to comply with safeguard regulations and procedures could result in specific penalties. The specific penalties for unauthorized disclosure include civil penalties (26 USC 7217) and criminal penalties (26 USC 7213 (a) (2) ).

Section 453 of the Act establishes the Federal Parent Locator Service (PLS) and specifies the conditions under which authorized persons can make requests to the Federal Parent Locator Service for information concerning the whereabouts of absent parents. The term "authorized person" is defined in Section 453(c) of the Act and in 45 CFR 302.70.

AT-77-02, State Employment Offices to Supply Data to Assist in the Administration of the Child Support Enforcement Program

Congress has enacted an amendment to the law which established a national unemployment system that requires State employment offices, notwithstanding any other provision of law, to provide specified information to the agency administering the State`s Child Support Enforcement program. Any expenses incurred in providing services requested by State IV-D agencies as specified in section 508 and charged the IV-D agencies by State employment agencies, are eligible for Federal financial participation.
