Changes in Work Permit Procedures in Hungary

Law No. XVI/2001 on the Labor Law and related laws contains a new regulation on the employment of foreign nationals, including US citizens, who do not have permanent resident alien status in Hungary. Section 3) of paragraph 76 states that "the employment contract - if it is subject to an official permit - may only be made after obtaining the permit". The effective date of the Law is July 1, 2001.

The above change means that should an office select a foreign national who does not have permanent resident alien status in Hungary for a vacancy, the office has to wait approximately 2 months, depending on how soon the selected applicant can collect all required documents, obtain visa and residence permit, before actually hiring the applicant.
The following steps are taken during the work permit, visa, residence permit procedure:
- Selected applicant submits all required documents to HR for arranging the work permit.
- Selected applicant returns to his/her home country and waits for receipt of the work permit.
- Upon receipt of the work permit, applicant visits the Hungarian Embassy in his/her country and requests a work visa presenting the work permit.
- Upon receipt of the visa, applicant returns to Hungary, and goes to the appropriate police station to obtain a residence permit, presenting the work permit and the work visa. The police will require the applicant to go through a thorough medical testing, and will issue the residence permit upon receipt of the results of the tests.
- Applicant is hired upon presentation of work permit and residence permit.

Please note that while the employer is required to initiate the work permit procedures, all other steps (obtaining work visa and residence permit) are the responsibility of the applicant.
