CHARTER

PRESIDENT'S COUNCIL ON PHYSICAL FITNESS AND SPORTS

Purpose

The purpose of the Council is to recommend programs to the President and the Secretary of Health and Human Services which will encourage nationwide participation in physical fitness, physical activity and sports activities. In making these recommendations, the Council will seek to enhance State, local, and private physical activity programs while stimulating and strengthening fitness opportunities in the public sector.

Authority

Executive Order 12345, dated February 2, 1982, as amended by Executive Orders 12694 and 13138, and continued by Executive Order 13225, dated September 28, 2001. The Council is governed by the provisions of Public Law 92-463, as amended (5 U.S.C., Appendix 2), which sets forth standards for the formation and use of advisory committees.

Function

The President's Council on Physical Fitness and Sports (PCPFS) advises the President and the Secretary of Health and Human Services concerning the progress made in carrying out the provision of the ten point national program set forth in Section I of Executive Order 12345. The Council shall advise the President and the Secretary on matters pertaining to ways and means of enhancing opportunities for participation in physical fitness, physical activity, and sports activities on State, local, and private actions to extend and improve physical activity programs and services.

Structure

The Council consists of 20 members. Members are appointed by, and serve at the pleasure of, the President. One or two members are selected to serve as the Chair, Vice Chair, and/or Co-chairs. Each member shall serve a term of two years and may continue to serve after expiration of the established term until a successor is appointed. A member appointed to fill an unexpired term will be appointed for the remainder of such term.

A program office to support activities of the PCPFS is located within the Office of Public Health and Science.  Management of program and staff operations is provided by the Executive Director.

Subcommittees composed of members of the parent committee shall be established to perform specific functions within the committee's jurisdictions. Where appropriate, advice may be sought by the Council or subcommittees from special consultants/advisors. The Department Committee Management Officer will be notified upon establishment of each subcommittee, and will be provided information on its name, membership, function, and estimated frequency of meetings.

Meetings

A minimum of one meeting shall beheld each year at the call of the Chair and/or Co-chairs with the advance approval of a government official, who also shall approve the agenda. A government official shall be present at all meetings.

Meetings shall be open to the public, except as determined otherwise by the Secretary. Notice of all meetings shall be given to the public.

Meetings shall be conducted and records of proceedings kept, as required by applicable laws and Department regulations.

Compensation

Members receive no compensation from the U.S. Government by reason of their service on the Council, but are reimbursed for travel expenses, including per diem in lieu of subsistence, as authorized by law and in accordance with Federal Travel Regulations.

Annual Cost Estimate

Estimated annual cost for operating the Council is $80,000. Estimate of annual staff years of support of 9 at an estimated cost of $568,623.

Reports

In the event a portion of a meeting is closed to the public, a report shall be prepared which shall contain, as a minimum, a list of members and their business addresses, the Committee's function, dates, and places of meetings, and a summary of committee activities during the fiscal year. A copy of the report shall be provided to the Department Committee Management Officer.

Termination Date

Unless renewed by appropriate action prior to its expiration, the President's Council on Physical Fitness and Sports will terminate on September 30,2003.Charter-Sigs3

The President's Council on Physical Fitness and Sports

By the authority vested in me as President by the Constitution and the laws of the United States of America, and to expand the executive branch's program for physical fitness and sports and establish the President's Council on Physical Fitness and Sports (the "Council"), it is hereby ordered as follows:

Section 1. Purpose. The Secretary of Health and Human Services (Secretary) shall, in carrying out his responsibilities for public health and human services, develop and coordinate a national program to enhance physical activity and sports participation. Through this program, the Secretary shall seek to:

(a) expand national interest in and awareness of the benefits of regular physical activity and active sports participation;

(b) stimulate and enhance coordination of programs within and among the private and public sectors that promote participation in, and safe and easy access to, physical activity and sports;

(c) expand availability of quality information and guidance regarding physical activity and sports participation;

(d) integrate physical activity into a broader health-promotion and disease-prevention effort through Federal agencies and the private sector; and

(e) target all Americans, with particular emphasis on children and adolescents, as well as populations or communities in which specific risks or disparities in participation in, access to, or knowledge about the benefits of physical activity have been identified.

Sec. 2. The President's Council on Physical Fitness and Sports.

(a) There is hereby established the President's Council on Physical Fitness and Sports.

(b) The Council shall be composed of up to 20 members appointed by the President. The President may designate one or more members to be Chair or Vice Chair. Each member shall serve for a term of 2 years and may continue to serve after the expiration of that term until a successor is appointed.

Sec. 3. Functions of the Council.

(a) The Council shall advise the President, through the Secretary, concerning progress made in carrying out the provisions of this order and shall recommend to the President, through the Secretary, actions to accelerate progress.

(b) The Council shall advise the Secretary on ways to enhance opportunities for participation in physical fitness and sports. Recommendations may address, but are not necessarily limited to, public awareness campaigns, Federal, State, and local physical activity initiatives, and partnership opportunities between public- and private-sector health-promotion entities.

(c) The Council shall function as a liaison to relevant State, local, and private entities in order to advise the Secretary regarding opportunities to extend and improve physical activity programs and services at both the local and national levels.

(d) The Council shall monitor the need for the enhancement of programs and educational and promotional materials sponsored, overseen, or disseminated by the Council, and shall advise the Secretary as necessary concerning such need.

Sec. 4. Administration.

(a) Each Federal agency shall, to the extent permitted by law and subject to available funds, furnish such information and assistance to the Secretary and the Council as they may request.

(b) The members of the Council shall serve without compensation for their work on the Council. Members of the Council may, however, receive travel expenses, including per diem in lieu of subsistence, as authorized by law for persons serving intermittently in the Government (5 U.S.C. 5701- 5707).

(c) To the extent permitted by law, the Secretary shall furnish the Council with necessary staff, supplies, facilities, and other administrative services. The expenses of the Council shall be paid from funds available to the Secretary.

(d) The Secretary shall appoint an Executive Director of the Council who shall serve as a liaison to the Secretary and the White House on matters and activities pertaining to the Council.

(e) The Council may establish subcommittees as appropriate to aid in its work. Such subcommittees shall meet on a voluntary basis and be defined by objectives established in coordination with and agreed upon by the Secretary and the President.

(f) The seal prescribed by Executive Order 10830 of July 24, 1959, as amended, shall be the seal of the President's Council on Physical Fitness and Sports established by this order.

Sec. 5. General Provisions.

(a) Insofar as the Federal Advisory Committee Act, as amended (5 U.S.C. App.) (Act), may apply to the Administration of any portion of this order, any functions of the President under the Act, except that of reporting to the Congress, shall be performed by the Secretary in accordance with the guidelines and procedures issued by the Administrator of General Services.

(b) In accordance with the Act, the Council shall terminate 2 years from the date of this order, unless extended by the President.

(c) Executive Order 12345 of February 2, 1982, as amended, is revoked.

The Committee shall initiate and assist in the development of (i) ways to promote public understanding and appreciation of the arts and the humanities; (ii) ways to promote private sector support for the arts and humanities; (iii) ways to evaluate the effectiveness of Federal support for the arts and humanities and their relationship with the private sector; (iv) the planning and coordination of appropriate participation (including productions and projects) in major national cultural events, including the Millennium; (v) activities that incorporate the arts and the humanities in government objectives; and (vi) ways to promote the recognition of excellence in the fields of the arts and the humanities."; and

(c) in section 3(b), add the following sentence after the first sentence: "Private funds accepted under the National Endowment for the Arts' or the National Endowment for the Humanities' gift authority may also be used to pay expenses of the Committee."

Sec. 8. Executive Order 12345, as amended, is further amended by deleting the first sentence of section 2(b) and inserting in lieu thereof the following three sentences. "The council shall be composed of twenty members appointed by the President. Each member shall serve a term of 2 years and may continue to serve after the expiration of their term until a successor is appointed. By virtue of the authority vested in me as President of the United States of America, and in accordance with the Federal Advisory Committee Act, as amended (5 U.S.C. App. 1), in order to expand the program for physical fitness and sports and to continue the President's Council on Physical Fitness and Sports, it is hereby ordered as follows:

Section 1. The Secretary of Health and Human Services shall, in carrying out his responsibilities for public health and human services, develop and coordinate a national program for physical fitness and sports. The Secretary shall:

(a) Enlist the active support and assistance of individual citizens, civic groups, private enterprise, voluntary organizations, and others in efforts to promote and improve the fitness of all Americans through regular participation in physical fitness and sports activities.

(b) Initiate programs to inform the general public of the importance of exercise and the link which exit between regular physical activity and such qualities as good health and effective performance.

(c) Strengthen coordination of Federal services and programs relating to physical fitness and sports participation and invite appropriate Federal agencies to participate in an interagency committee to coordinate physical fitness and sports activities of the Federal establishment.

(d) Encourage State and local governments to emphasize the importance of regular physical fitness and sports participation.

(e) Seek to advance the physical fitness of children, youth, adults, and senior citizens by systematically encouraging the development of community recreation, physical fitness, and sports participation programs.

(f) Develop cooperative programs with medical, dental. and other similar professional societies to encourage the implementation of sound physical fitness practices and sports medicine services.

(g) Stimulate and encourage research in the areas of sports medicine, physical fitness, and sports performance.

(h) Assist educational agencies at all levels in developing high quality, innovative health and physical education programs which emphasize the importance of exercise to good health,

(i) Assist recreation agencies and national sports governing bodies at all levels in developing "sports for all" programs which emphasize the value of sports to physical, mental, and emotional fitness.

(j) Assist business, industry, government, and labor organizations in establishing sound physical fitness programs to elevate employee fitness and to reduce the financial and human costs resulting from physical inactivity.

Sec. 2. President's Council on Physical Fitness and Sports.

(a) There is hereby continued the President's Council on Physical Fitness and Sports.

(b) The Council shall be composed of fifteen members appointed by the President. The President shall designate one of the members to be the Chairman.

Sec. 3. Functions of the Council

(a) The Council shall advise the President and the 'Secretary concerning progress made in carrying out the provisions of this Order and shall recommend to the President and the Secretary, as necessary. actions to accelerate progress.

(a) The Secretary and the Council are authorized to request from any Federal agency such information or assistance deemed necessary to carry out their functions under this Order.

(b) Each Federal agency is authorized to the extent permitted by law end within available funds, to furnish such information and assistance to the Secretary and the Council as they may request.

(c) The members of the Council shall serve without compensation for their work on the Council. However, members of the Council may receive travel expenses, including per diem in lieu of subsistence, as authorized by law for persons serving intermittently in government service (5 U.S.C. 5701-5707).

(d) To the extent permitted by law, the Secretary shall furnish the Council with necessary staff, supplies, facilities, and other administrative services. The expenses of the Council shall be paid from funds available to the Secretary.

(e) The Secretary shall appoint an Executive Director of the Council.

(f) The seal prescribed by Executive Order No. 20830 of July 24, 1959, as amended, shall continue to be the seal of the President's Council on Physical Fitness and Sports continued by this Order

Sec. 5. General Provisions Concerning the Council.

(a) Notwithstanding the provisions of any other Executive Order, the functions of the President under the Federal Advisory Committee Act, are amended (5 U.S.C. App. I), except that of reporting annually to the Congress, shall be performed by the Secretary in accordance with guidelines and procedures established by the Administrator of General Services.

(b) In accordance with the Federal Advisory Committee Act, as amended, the Council shall terminate on December 31, 1982, unless sooner extended.

(c) Executive Order No. 11562, as amended, is revoked.

CHARTER

PRESIDENT'S COUNCIL ON PHYSICAL
FITNESS AND SPORTS

Purpose

The purpose of the Council is to recommend programs to the President and the Secretary of Health and Human Services which will encourage nationwide participation in physical fitness, physical activity and sports activities. In making these recommendations, the Council will seek to enhance State, local, and private physical activity programs while stimulating and strengthening fitness opportunities in the public sector.

Authority

Executive Order 12345, dated February 2, 1982, as amended by Executive Order 12694, and continued by Executive Order 13138, dated September 30, 1999. The Council is governed by the provisions of Public Law 92-463, as amended (5 U.S.C., Appendix 2), which sets forth standards for the formation and use of advisory committees.

Function

The President's Council on Physical Fitness and Sports (PCPFS) advises the President and the Secretary of Health and Human Services concerning the progress made in carrying out the provision of the ten point national program set forth in Section I of Executive Order 12345. The Council shall advise the President and the Secretary on matters pertaining to ways and means of enhancing opportunities for participation in physical fitness, physical activity; and sports activities on State, local, and private actions to extend and improve physical activity programs and services.

Structure

The Council consists of 20 members. Members are appointed by, and serve at the pleasure of, the President. One or two members are selected to serve as the Chair or Co-chairs, respectively. Each member shall serve a term of two years and may continue to serve after expiration of the established term until a successor is appointed. A member appointed to fill an unexpired term will be appointed for the remainder of such term.

A program office to support activities of the PCPFS is located within the Office of Public Health and Science. Management of program and staff operations is provided by the Executive Director.

Subcommittees composed of members of the parent committee shall be established to perform specific functions within the committee's jurisdictions.  Where appropriate, advice may be sought by the Council or subcommittees from special consultants/advisors. The Department Committee Management Officer will be notified upon establishment of each subcommittee, and will be provided information on its name, membership, function, and estimated frequency of meetings.

Meetings

A minimum of one meeting shall be held each year at the call of the Chair and/or Co-chairs with the advance approval of a government official, who also shall approve the agenda. A government official shall be present at all meetings.

Meetings shall be open to the public, except as determined otherwise by the Secretary. Notice of all meetings shall be given to the public.

Meetings shall be conducted and records of proceedings kept, as required by applicable laws and Department regulations.

Compensation

Members receive no compensation from the U.S. Government by reason of their service on the Council, but are reimbursed for travel expenses, including per diem in lieu of subsistence, as authorized by law and in accordance with Federal Travel Regulations.

Annual Cost Estimate

Estimated annual cost for operating the Council is $70,000. Estimate of annual staff years of support of 9 at an estimated cost of $521,637.

Reports

In the event a portion of a meeting is closed to the public, a report shall be prepared which shall contain, as a minimum, a list of members and their business addresses, the Committee's function, dates, and places of meetings, and a summary of committee activities during the fiscal year. A copy of the report shall be provided to the Department Committee Management Officer.

Termination Date

Unless renewed by appropriate action prior to its expiration, the President's Council on Physical Fitness and Sports will terminate on September 30,2001.
