SUBJECT: Compilation of the federal regulations implementing the Low Income Home Energy Assistance Act and the Low Income Home Energy Assistance Program

PURPOSE: To transmit a current compilation of the federal regulations implementing the Low Income Home Energy Assistance Program and certain other block grant programs administered under the U.S. Department of Health and Human Services (HHS).

BACKGROUND: On July 6, 1982, HHS published in the Federal Register final regulations (final rules) for the Low Income Home Energy Assistance Program and certain other block grant programs that it administers at the federal level. These regulations comprise Part 96 of Title 45 of the Code of Federal Regulations (45 CFR Part 96.)

Since then, HHS has issued a number of additional final rules that amend these block grant regulations. The most important amendments affecting the LIHEAP program were published in the Federal Register on October 13, 1987; March 3, 1988; and May 1, 1995.

Periodically, the Office of the Federal Register publishes compilations of federal regulations that include all amendments made to them to date. This IM transmits the compilation that includes changes made to the block grant regulations as of October 1, 1996. Since that date, there have been no changes to the block grant regulations affecting the LIHEAP program.

LIHEAP grantees must comply with these regulations. HHS must comply with them as well.

Earlier, we transmitted this compilation in IM-97-15. We are transmitting it again, to help assure that all LIHEAP grantees have copies of, and follow, these regulations.

Federal regulations are first published in the Federal Register (FR), and then they are compiled in the Code of Federal Regulations (CFR). When HHS publishes its regulations in the Federal Register, it includes preambles which contain important background information and guidance. Compilations of regulations in the Code of Federal Regulations do not include the preambles. However, the material in the preambles is still in force unless it is superseded or replaced by federal regulation(s) or preamble(s) published later, or by federal law(s).

The original HHS block grant final regulations and their preamble were published in the Federal Register on July 6, 1982, and may be found at 47 FR 29472 (volume 47 of the Federal Register, starting at page 29472) and in LIHEAP Information Memorandum (IM) 82-12 dated September 24, 1982. The October 13, 1987, final rule amending the block grant regulations, and its preamble, may be found at 52 FR 37957 and in IM-88-3 dated November 6, 1987. The March 3, 1988, final rule amending the block grant regulations, and its preamble, may be found at 53 FR 6824 and in IM-88-9 dated March 15, 1988. The May 1, 1995, final rule amending the block grant regulations, and its preamble, may be found at 60 FR 21322 and in IM-95-20 dated June 9, 1995.
