MEMORANDUM FOR DIRECTORS OF PERSONNEL (CPM 97-5)

SUBJECT:  Guidance on AUO Pay

The Office of Personnel Management (OPM) has prepared additional guidance on administratively uncontrollable overtime (AUO) pay to assist Federal agencies in complying with the law and OPM regulations. We request that each agency provide a copy of the attached guidance as well as corresponding updates in internal agency policy directives or regulations on AUO pay to each manager or supervisor who administers AUO pay and to each employee receiving AUO pay in your agency.

Section 650 of the Treasury, Postal Service, and General Government Appropriations Act, 1997, as contained in section 101(f) of Public Law 104-208, the Omnibus Consolidated Appropriations Act, 1997, required the Inspector General of any agency that pays annual premium pay for AUO work to conduct an audit of the use of AUO pay in that agency. Section 650 also required OPM to issue revised guidelines to agencies after the Inspectors General reports were submitted to OPM and designated congressional committees.

The deadline for the Inspectors General reports was extended until the end of January 1997. At the request of Senator John McCain, OPM provided interim guidance on AUO pay in a Memorandum for Directors of Personnel on December 30, 1996 (CPM 96-19). This memorandum provides revised guidance based on OPM's review of the Inspectors General reports.
