Hasta hace poco la Unidad de Visas de inmigrante aceptaba solicitudes de ciudadanos estadounidenses no residentes en Colombia, para las visas de cónyuges e hijos menores de 21 años. Sin embargo, debido al altísimo volumen de solicitudes, a partir del 1º de julio de 2003, un ciudadano estadounidense quien no resida en Colombia, debe solicitar la visa de inmigrante para sus familiares inmediatos (cónyuges e hijos menores de 21 años) ante el Departamento de la Seguridad del Territorio Nacional, DHS, en el estado de su residencia.
The Department of Homeland Security (DHS) has delegated the authority to Immigrant Visa issuing posts overseas to approve petitions filed by U.S. citizens. As a rule, the petitioner must be a resident of the Consular District in which he/she is filing. The U.S. Embassy has discretion to approve petitions for non-resident U.S. citizens in emergency or humanitarian cases as well as those in the national interest.
Until recently, the Immigrant Visa Unit accepted petitions for spouses and children under the age of 21 from non-resident U.S. citizens. However, due to the overwhelming volume of petition filings, effective July 1, 2003, a U.S. citizen who does not reside in Colombia, must file a petition for spouse and children under 21, at the DHS center that services the state in which he/she resides. |
