When Military Service is Creditable Toward Benefits Under the Railroad Retirement Act

Credit may be allowed for active service in our Armed Forces if, before entering such service, the employee performed creditable railroad service in the same year the military service began or in the preceding year, and he:

1. Entered such service voluntarily or involuntarily during one of the following periods:

A. April 6, 1917 through November 11, 1918 (World War I)

B. September 8, 1939 through June 14, 1948 (state of national emergency including World War II)

C. December 16, 1950 through September 14, 1978 (state of national emergency); or

2. Was required to enter and continue in military service during the period May 9, 1916 to February 5, 1917 (Mexican Border Disturbances); or

3. Entered military service involuntarily or was ordered to active duty during the period June 15, 1948 through December 15, 1950; or

4. Entered military service voluntarily during the period June 15, 1948 through December 15, 1950, and upon release from such service returned to railroad service in the same year, or the year immediately following such year, without any non-railroad employment of any duration occurring after the military service and before the return to railroad service; or

5. Was required to enter military service involuntarily and continue in military service during any other period, by call of the President, or by an Act of Congress or regulation, order or proclamation pursuant thereto.

When an individual entered military service in any of the above-stated periods and otherwise meets the requirements set forth above, he is entitled to credit for all military service performed prior to his discharge or reenlistment unless:

A. The individual voluntarily entered military service during the period January 1, 1947 through June 14, 1948, and upon release from such service did not return to railroad service in the same year or the year immediately following, or did return, but had non-railroad employment of any duration occurring after the military service and before the return to railroad service. In this event, the individual is entitled to credit for military service only through June 14, 1948, or the date of discharge, whichever is earlier; or

B. The individual voluntarily entered military service after December 15, 1950, and before September 15, 1978. In this event, the individual is entitled to credit for military service only through September 14, 1978, or the date of discharge, whichever is earlier.
