Privacy Statement

Completion of the Informal Complaint Form is voluntary. You should be aware that the Internet is not always secure against interception. If you want to provide sensitive information to us, you should consider sending us a Complaint Letter by postal mail instead of using the on-line Informal Complaint Form 475.

Section 1.719 of the FCC's Rules, 47 C.F.R. §§ 1.719, requires complaints to be in writing. Section 1.717 of the FCC's Rules, 47 C.F.C. § 1.717, requires the FCC to forward complaints to the appropriate carrier for investigation. A copy of your completed Complaint Form will be served on all companies identified in your complaint that are within the FCC's jurisdiction or that may, in the staff's view, assist in the resolution of the complaint. We serve a consumer's complaint by issuing an "Official Notice of Informal Complaint" to each company under Section 1.711 of the FCC's Rules, 47 C.F.R. §1.7ll, and Sections 258 and 4(i) of the Communications Act, 47 U.S.C. §§ 258, 154(i).

Privacy Act System of Records:  The FCC maintains a system of records, FCC/CIB-1, Informal Complaints and Inquiries File,  66 Fed. Reg. 51955-51957 (Oct. 11, 2001) that contains information about informal complaints filed against carriers. The information that you submit to us may be made accessible to various sources as routine uses of records maintained in the system, including our attorneys and other FCC staff members involved in law enforcement or public policy development. In processing any informal complaints received from individuals, groups, and other entities, we may forward the complaint to the defendant entity for a response. Moreover, when an order or other Commission issued document that includes consideration of informal complaints is entered by the FCC to implement the Communications Act, pertinent rule, regulation, or order of the FCC, the complainant’s name may be made public in that order or document, as necessary. We also may share the information with other Federal, State or local government agencies where there is an indication of a violation or potential violation of a statute, regulation, rule, or order; in any legal proceeding to which the Commission is a party before a court or administrative body; to the Department of Justice or in a proceeding before a court or adjudicative body; to a Congressional office in response to an inquiry the individual has made to the Congressional office; and to GSA and NARA for the purpose of records management inspections conducted under authority of 44 U.S.C. 2904 and 2906.

You may be contacted directly by the FCC or any of the other government agencies with which we share the information that you submit. Under certain circumstances -- including requests from Congress or private individuals -- we may be required by law to disclose information that you submit.

Please do not include personal information -- such as your social security number, credit card numbers, pre-paid calling card numbers, bank or checking account numbers, etc. -- in your responses to the questions asked in the Complaint Form. The FCC will contact you if we need this type of sensitive information.

We have estimated that each response to this collection of information will take, on average, 15 minutes. Our estimate includes the time to read the instructions, look through existing records, gather and maintain required data, and actually complete and review the form or response. If you have any comments on this estimate, or how we can improve the collection and reduce the burden it causes you, please write the Federal Communications Commission, AMD-PERM, Paperwork Reduction Project (3060-0874), Washington, D.C. 20554. PLEASE DO NOT SEND COMPLETED COMPLAINT FORMS TO THIS ADDRESS.

Remember: You are not required to respond to a collection of information sponsored by the federal government, and the government may not conduct or sponsor this collection, unless it displays a currently valid OMB control number and provides you with this notice. This collection has been assigned an OMB control number of 3060-0874.
