DELEGATION OF AUTHORITY TO ENTER INTO GRANTS, COOPERATIVE AGREEMENTS, AND "OTHER TRANSACTIONS"

You are hereby de1egated authority to enter into grants and cooperative agreements under 10 U.S.C. §2358; and transactions other than contracts, cooperative agreements and grants under 10 U.S.C. §2371 ("other transactions"). This authority may be redelegated. Reference (a) is hereby rescinded. By separate memorandum, the Secretary of the Navy will be requested to rescind reference (b).

Grants and cooperative agreements under 10 U.S.C. §2358 are authorized for research and development projects. "Other transactions" under 10 U.S.C §2371 are authorized for basic, applied, and advanced research projects, and only when the use of a standard contract, grant, or cooperative agreement for such a project is not feasible or appropriate. Reference (c) provides interim guidance for the exercise and redelegation of this authority.

I encourage you to use "other transactions" where innovative use of these agreements would provide a substantial benefit to the Department of the Navy. Further guidance will be forthcoming from the Deputy, Acquisition and Business Management.

In accordance with DOD Directive 3210.6, the Chief of Naval Research is hereby designated as the Department of Navy official responsible for coordinating with the Director, Defense Research and Engineering and the other military departments on the Defense Grants and Agreement Regulatory System. The Chief of Naval Research is also designated to provide the required data to the Department of Defense to be included in the annual report required by 10 U.S.C. §2371(h). All others delegated authority herein are required to submit the data necessary for the filing of the annual report to the Chief of Naval Research.
