Eligibility criteria
A worker or former worker may be eligible for benefits under the program if (a) he or she has or had radiation-induced cancers, beryllium diseases or silicosis, and (b) he or she was exposed to radiation, beryllium or silica while working in the nuclear weapons industry for the Department of Energy or its contractors or subcontractors. Uranium miners, millers, and ore transporters may be eligible for benefits if they have received an award of benefits under Section 5 of the Radiation Exposure Compensation Act from the Department of Justice. If a covered worker has died, his or her survivors may be eligible for benefits.
Description
Energy Employees' Occupational Illness Compensation provides for lump-sum payments of up to $150,000 to covered employees and qualified survivors of such employees of the Department of Energy (DOE), its predecessor agencies and certain of its vendors, contractors and subcontractors who were exposed to radiation, beryllium, or silica during work performed in the production or testing of the nation's nuclear weapons program. The Act also provides supplemental lump-sum payments of up to $50,000 to individuals already found eligible for benefits for illness due to uranium exposure under Section 5 of the Radiation Exposure Compensation Act (RECA) and, where applicable, for their survivors. In addition medical benefits are payable for treatment of covered conditions.
