New York -- Suburban Guns (Pty) Ltd., of Capetown, South Africa has been fined $10,000, placed on two years probation and ordered to pay a $600 special assessment fee by U.S. District Court Judge Loretta Preska of New York's Southern District for illegally exporting shotguns, rifles, and ammunition to South Africa without the required export licenses, the Commerce Department's Bureau of Export Administration announced.
The criminal penalties were imposed after the company pleaded guilty on Feb. 10, 1997 to charges that it violated the Export Administration Act, the International Emergency Economic Powers Act and the Comprehensive Anti-Apartheid Act in making the exports without licenses from the Commerce and State Departments. Phaedon Nicholas Criton Constan-Tatos, also known as "Fred" Tatos, Managing Director of Suburban Guns, appeared at sentencing on behalf of the company.
The Commerce Department's Office of Export Enforcement New York field office and the U.S. Customs Service investigated the case. The Department of Commerce controls and licenses the export and reexport of dual-use commodities and technical data. The Department's Bureau of Export Administration maintains and enforces these controls for reasons of national security, foreign policy, nonproliferation and short supply.
In April of 2002 the Bureau of Export Administration (BXA) changed its name to the Bureau of Industry and Security(BIS). For historical purposes we have not changed the references to BXA in the legacy documents found in the Archived Press and Public Information.
