Massachusetts Exporter Pays $125,000 Penalty to Settle Charges of Unlicensed Exports

WASHINGTON -- The Commerce Department's Bureau of Export Administration today imposed a $125,000 civil penalty on President Titanium of Hanson, Massachusetts, for the alleged unlicensed export of titanium bars from the U.S. to various foreign countries, Acting Assistant Secretary for Export Enforcement Frank Deliberti announced.

President Titanium agreed to pay the penalty to settle alleged violations of the export control regulations. The Commerce Department alleged that on 25 separate occasions President Titanium exported titanium bars from the U.S. to England, France, Germany, Sweden, South Africa, Switzerland, and the Netherlands without the required validated licenses.

"President Titanium and the related cases demonstrate that both exporters and forwarders are responsible for complying with U.S. export control laws. These cases show a classic situation where the exporter failed to obtain the required export license and failed to provide information to its freight forwarders. The forwarders --in absence of any licensing information, filled out export control documents stating that validated licenses were not required," Deliberti said.

Today's action is the final settlement in a series of related cases. The other four cases involved the freight forwarders hired by President Titanium. They resulted in civil penalties totaling $65,000 against the forwarders for allegedly making false statements on export control documents. The Bureau of Export Administration's Boston Field Office conducted the investigation.

Commerce's Bureau of Export Administration administers and enforces controls for reasons of national security, foreign policy, nonproliferation and short supply. Criminal penalties, as well as administrative sanctions, can be imposed for violations of the regulations.
