- Common and Contract Carriers No Longer Have to Complete an Explosives
Delivery Record Form (9/11/03)
The Department of Justice issued an interim rule today removing the
requirement that common or contract carriers taking possession of explosive
materials for delivery to a licensee or permittee complete ATF Form
5400.8 (Explosives Delivery Record) prior to taking possession of explosive

- ATF Ruling 2003-5, Distribution of Explosives to Limited Permittees
(5/23/03)
Distributors distributing explosive materials to holders of limited
permits via common or contract carrier may verify receipt of the explosive
materials by telephone, facsimile, e-mail, or other means within three
business days of shipment in lieu of requiring the common or contract
carrier to verify the identity of the person accepting delivery of the

- Two New Forms Available (5/09/03)
Two new forms, the
ATF F 5400.4, Limited Permittee Transaction Report (LPTR), formerly
titled Explosives Transaction Record, and the ATF F 5400.8, Explosives
Delivery Record, are available on the ATF website. These forms will
be required to be used effective May 24, 2003. Until May 24, 2003, the
ATF F 5400.4, Explosives Transaction Record, dated 12/10/02, and the
ATF F 5400.8, Explosives Delivery Record, dated 7/98, should continue
to be used. ATF is making every effort to have these forms distributed
to Federal explosives licensees by May 24, 2003. If you do not receive
a supply of these forms by May 24, 2003, you may download them and copy
them for use until you receive your supply. If you have any questions
regarding these forms, please call the Public Safety Branch at 202-927-2310.

- Announcement of the New Federal Explosives License and Permit
Application
Effective immediately, please be advised that in order to apply for
a Federal explosives license/permit (FEL), you MUST contact the National
Explosives Licensing Center (NELC) at (404) 417-2750. However, for
your convenience the new Federal explosives license/permit application
and Employee Possessor Questionnaire may be downloaded from the links
below. Please be advised that your application package will not be
considered complete without the proper FD-258, FBI Fingerprint Card
(ORI # ATF-GA-9900), which can only be obtained by contacting the
NELC.

be sent to all Federal explosives licensees and permittees. An insert
accompanies the poster.
It requests that the poster
be displayed as a reminder to customers that beginning May 24, 2003,
they must have a Federal explosives license or permit to receive or
purchase explosive materials.

- Recent Regulations Issued by the Department of Transportation and
the Transportation Security Administration on Commercial Transportation
of Explosives (8/11/03)
On May 2, 2003, and on June 9, 2003, the Department of Transportation
(DOT) and the Transportation Security Administration (TSA) promulgated
three interim final rules and a notice generally exempting from 18 U.S.C.
§ 842(i) the transporting, shipping, receiving, and possessing
of explosives incident to and in connection with the commercial transport
of explosives by motor carrier, water, and air and rail. Read

- Explosives Transportation Issues Related to the Safe Explosives
Act
On February 3, 2003, the Transportation Security Administration
(TSA), an agency of the Department of Transportation (DOT), issued a
regulation regarding the transportation of explosives by commercial
motor vehicles and railroads. See 68 Fed. Reg. 6083 (February 6, 2003)
(to be codified at 49 C.F.R. pt. 1572). The regulation sets forth rules
for the lawful commercial transportation of explosives into the United
States from Canada by railroad and commercial motor carrier not using
United States citizens or lawful permanent residents as drivers or railroad
