DECISION OF THE BOARD OF DIRECTORS

On December 14, 2002, Hearing Officer Sylvia Bacon issued her attached Decision and Judgment dismissing this age discrimination and reprisal complaint on its merits after conducting an evidentiary hearing. The Complainant timely filed a petition for review of the Hearing Officer’s decision and a supporting brief. The Respondent employing office filed a brief in opposition to the petition for review.

Upon due consideration of the Hearing Officer’s Decision and Judgment, and the parties’ filings, the Board affirms the Hearing Officer’s dismissal of this complaint. The Board is satisfied that the Hearing Officer’s decision is supported by substantial record evidence and that the Hearing Officer employed the correct legal principles and analysis in reaching her result.

For the foregoing reasons, the Hearing Officer’s decision dismissing the complaint
is affirmed.

It is so ordered.
