ELECTRONIC FORMS FOR SUBMITTING MADRID-PROTOCOL RELATED DOCUMENTS ARE UNAVAILABLE


Please be advised that because of technical difficulties, the USPTO has delayed the posting of electronic forms for filing documents related to the Madrid Protocol. Until the USPTO posts these forms, international applications, subsequent designations, and responses to notices of irregularities must be submitted on paper. When submitting paper documents, applicants/holders should use the forms provided by the International Bureau (IB) of the World Intellectual Property Organization. These forms are available at the IB web site at http://www.wipo.int/madrid/en/. These forms can be completed online, printed, and then mailed or hand delivered to the USPTO. Please note that the IB will not accept an international application or subsequent designation that does not appear on an IB form.

International applications submitted on paper must be accompanied by the USPTO certification fee, and subsequent designations submitted on paper must be accompanied by the USPTO transmittal fee. However, these submissions should not include the international fees that are charged by the IB. Instead, those fees should be sent directly to the IB.

All Madrid-related documents should be mailed to the USPTO at the following address:

This address should be used only for Madrid-related documents. Any other trademark-related documents that are mailed to this address will not be accepted, and will be returned to the sender.

Applicants who wish to hand deliver Madrid-related documents to the USPTO should submit these documents to the Trademark Assistance Center, which is located at 2900 Crystal Drive, Arlington Virginia, 4th Floor. The Trademark Assistance Center is open from 8:30 a.m. until 5:00 p.m. on all weekdays, except holidays.

A notice will be published in the Federal Register announcing that the USPTO has postponed the effective date of the 37 C.F.R. §§7.7, 7.11, 7.14 and 7.21, to the extent that these rules require electronic filing of Madrid documents, and to the extent that these rules require that all international fees be submitted to the USPTO at the time of filing.

The USPTO expects to post the electronic forms in the near future. A notice announcing that posting will be distributed at least five days before the posting occurs.
