TRADEMARK ELECTRONIC APPLICATION SYSTEM (TEAS)

    Up-Coming TEAS Enhancements

Expanded Image File Types
    • Currently, TEAS will only accept the attachment of image files that are in the JPG format. In response to customer requests, the Office of the Chief Information Officer is continuing to explore possible future technical changes to the TEAS environment, which would allow for the attachment of other image files types, e.g., PDF files.
Enhanced signature options for Revocation/Appointment of Attorney/Domestic Representative form
  • On October 2, the USPTO deployed the electronic form for a Revocation of Attorney/Domestic Representative and/or Appointment of Attorney/Domestic Representative. Because this form uses a different software structure than the previous TEAS forms, existing code could not be used, which thereby prevented the direct import of the e-e-signature and handwritten pen-and-ink signature options featured in the other TEAS forms.
Those signature features WILL be added in the next TEAS release, which is currently scheduled for November 6. However, in the meantime, the USPTO thought it beneficial to at least offer a form that never existed before, since it does enable something to be done electronically that was heretofore not possible. We recognize that the current iteration may not be ideal for how law firms may wish to interact with clients; nonetheless, the current form does permit a client to effectuate a revocation and/or appointment electronically. Please note that the existing form does also have a download portable feature, which would permit the law firm to prepare the form, download and save it, and then attach it for conventional e-mail transmission. The client could sign the form, download and save it, and e-mail it back to the law firm, for submission to the USPTO. This method is obviously not as "easy" for the client as our other e-signature or pen-and-ink signature methods, but it is an option.

With the planned enhancement of November 6, we hope that this form will better meet the needs of all TEAS users.
Madrid Protocol: Electronic filing AND paper filing acceptable beginning November 1, 2004. As of that date, the USPTO will have posted electronic forms for the submission of international applications, subsequent designations, and responses to notices of irregularities. These forms will be accessible from the heading “Madrid Protocol Forms,” under the “Forms” column on the right side of the TEAS front page. Paper submissions will continue to be acceptable.
