Instructions for E-Filed Form I-129s

Form:

I-129S, E-File Nonimmigrant Petition Based on Blanket L Petition (login at bottom of page)

Purpose of Form:

For employers to classify employees as L-1 nonimmigrant intra-company transferees (executives, managers, or specialized knowledge professionals) under a blanket L petition.

Who Is Not Eligible to E-File This Form:

    You are not eligible to E-File this form if:
    • You are applying for a waiver of the filing fee.
    • You are requesting that your case be expedited.
    • You are not able to classify employees as L-1 nonimmigrant intra-company transferees (executives, managers, or specialized knowledge professionals) under a blanket L petition.

Who Is Eligible to E-File This Form:

An employer who has already obtained approval of a blanket L-1 petition may file this form to classify employees outside the United States as executives, managers, or specialized knowledge professionals. NOTE: If the employee is in the United States and you are requesting a change of status or extension of stay for that employee, E-File the Form I-129, Petition for a Nonimmigrant Worker.

Concurrent E-Filing:

E-Filed I-129S petitions cannot be concurrently E-Filed with any other E-Filing application.

Helpful Hints:

    Helpful Hint 1: If you are E-Filing I-129S and you wish to E-File an I-539 for a dependant, you should complete and submit Form I-129S first.

    You will need to provide the I-129S Receipt Number (provided on your E-Filing Confirmation Receipt notice) in Part 3, Question #3 of the I-539.
