The Notification and Federal Employee Antidiscrimination and Retaliation Act of 2002 (“No FEAR Act”) requires, inter alia, that each federal agency post “on its public Web site certain statistical data relating to Federal sector equal employment opportunity complaints filed with such agency.” Public Law 107-174. Recognizing that some data will be unavailable, the Equal Employment Opportunity Commission (“EEOC”), as the agency responsible for promulgating rules to comply with the posting requirement under Section 301 of the No FEAR Act, has provided that “[i]f an agency does not have data for one or more of the preceding five fiscal years, the Act requires that the agency post whatever data it has available for any of those five years.” Equal Employment Opportunity Commission’s Interim Final Rule: Posting Requirements in Federal Sector Equal Employment Opportunity.
In compliance with the No FEAR Act, the United States Postal Service provides currently available EEO complaint data. This data is subject to change pending clarification and final rules from the EEOC.
