Family-Sponsored Immigrant Visas


The son or daughter (over 21), and siblings of American citizens, and spouse, unmarried son or daughter of permanent resident alien are eligible for immigrant visas (IV). A stepson or stepdaughter is also eligible if the step-relationship was formed before the child's eighteenth birthday. The first step is for the U.S. citizen or permanent resident alien sponsor (petitioner) to file an immigrant petition Form I-130 for his or her foreign relative (beneficiary) withthe U.S. Department of Homeland Security(DHS), Citizenship and Immigration Services (CIS) - no petition, no IV. At the petition stage the BCIS determines if the relationships and identities of the petitioner and beneficiary satisfy the requirements of immigration law.

The I-130 contains detailed instructions on how to complete the form and what kind of supporting documents are needed. Further details are available at www.uscis.gov.



Blank I-130 forms can be obtained on-line, directly from BCIS offices in the United States or at the U.S. Embassy Seoul. U.S. Forces Korea personnel may obtain I-130s from their personnel or legal offices.




Please note that Congress sets an annual cap on the number of family IVs with further limits on the number that can be issued to persons from any one country. Family preference IVs are processed according to the date the I-130 fee was accepted by the BCIS. To learn the waiting period for such visas, please refer to cut-off dates.
 

USCIS forwards all approved petitions to the U.S. State Department's National Visa Center (NVC) for IV processing. As each petition reaches its qualifying date, NVC will send an Affidavit of Support (I-864 form) processing fee bill to the petitioner and an Agent of Choice and Address (DS-3032) form to the applicant. Once the I-864 processing fee is paid, NVC will send the I-864 forms and instructs to the petitioner. Once NVC receives the form DS-3032 from the applicant, NVC will mail the Immigrant Visa (IV) fee bill to the agent of choice. Once the IV fee bill is paid, NVC will send the instruction Packet of forms and information to the agent or the applicant. When NVC receives completed I-864 and DS-230 Part 1 , NVC will forward the petition to the Embassy for further processing. Petitions which have not reached their qualifying dates are held at NVC.


When the qualifying date is reached, NVC or CONS/IV sends to the applicant a detailed list of the supporting documents (OF-169 / SEO3.5) needed to apply for the IV. It is solely the applicant's responsibility to take the necessary steps and inform CONS/IV of his or her intentions. When the applicant faxes CONS/IV an appointment request, we will request IV numbers from Washington. If we receive the applicant's request before the 14th of the month, we expect to schedule a visa appointment during the month after the following month. All IVs are interviewed by appointment only. If the applicant is found eligible for an IV, the visa will normally be issued the same day. If an applicant is found ineligible for an IV, the reason for the refusal and any recourse will be explained in writing.

The IV application fee is $335. IVs are generally valid for six months. All fees are payable in cash (dollars or Korean won) or cashier's check. We also accept VISA, Mastercard, American Express, Discover, Diner's credit cards. We can not accept personal checks.
