The Arbitrator found that the grievant, whose three-day suspension was rescinded by the Agency during the pendency of the grievance process, was entitled to attorney fees under the Back Pay Act. The Authority set aside the award as inconsistent with the Back Pay Act, 5 U.S.C. § 5596.
