The complaint alleged that the Respondent violated § 7116(a)(1), (5) and (8) of the Federal Service Labor-Management Relations Statute by refusing to furnish the Union with data requested pursuant to § 7114(b)(4) of the Statute. The Judge found that the Respondent violated the Statute, as alleged, and ordered the Respondent to furnish the data on request of the Union.
Upon consideration of the Judge's decision and the entire record, the Authority concluded that disclosure of the requested data was prohibited by law. Accordingly, the Authority found that the Respondent did not commit the unfair labor practices alleged and dismissed the complaint.
