Applications/Petitions Filed at Specific Service Centers:
There are some applications that must be filed with a specific Service Center regardless of where an applicant or petitioner lives. Those applications are:

  • All Forms I-131, Application for Travel Document (for Re-entry Permit or Refugee Travel Document only), are filed with the Nebraska Service Center.
  • All Forms I-360, Self-Petitions filed by Battered Spouse or Child are filed at the Vermont Service Center.
  • All Forms I-485, for Refugees, Asylees, Haitians, Indochinese Parolees are filed with the Nebraska Service Center. On this site, we have information on adjustment of status for asylees (including expected timeframes for processing).
  • All Forms I-526, Immigrant Petition by Alien Entrepreneur, are filed at either the California Service Center or Texas Service Center. Please see the Form I-526 for filing instructions.
  • All Forms I-730, Refugee/Asylee Relative petitions are filed with the Nebraska Service Center.
  • All Forms I-905, Application for Authorization to Issue Certification for Health Care Workers are filed with the Nebraska Service Center.

Applications for asylum (Form I-589) may require filing at a different Service Center than indicated above; please check the instructions for Form I-589 to determine where you should file your application.

Applications/Petitions Filed at Local Office but Processed at the NSC:
The following applications must be submitted to a local office but may be forwarded by that office to the NSC for processing.

       Form I-90 Application to Replace Alien Registration Card (Applications to renew a 10-year expiring “green card” are submitted to Application Support Centers)
 
       Form I-212 Application for Permission to Reapply for Admission into the United States After Deportation or Removal
 
       Form I-612 Application for Waiver of the Foreign Resident Requirement of Section 212(e) of the Immigration and Nationality Act, as amended

Since all applications and petitions adjudicated at the NSC are entered into the electronic receipting systems for tracking, any application or petition received at the NSC which has been accepted elsewhere by a USCIS office will be assigned a "LIN" (short for Lincoln, Nebraska) number. Petitioners and applicants will then receive a receipt notice from the Center that will indicate their LIN receipt number.

Expediting Cases/Expeditious Handling Requests:
Effective June1, 2001, there are only two ways that a case may be worked out of date order: Premium Processing and the traditional expedite process.

Petitioners whose Form I-129 classification is available for Premium Processing will not be considered for expeditious processing. The sole exception to this guideline would be nonprofit organizations.

Expedite requests for all other applications and petitions will be considered based upon the following seven criteria:

  1. Severe financial loss to company or individual.
  2. Extreme emergent situation.
  3. Humanitarian situation.
  4. Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States.
  5. Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our government.)
  6. USCIS error.
  7. Compelling interest of the USCIS.

Requests for expeditious handling that do not meet these criteria will not be granted and the petition will be returned to the regular processing queue.

To request an expedite, state "EXPEDITE REQUEST" in the heading of the letter requesting the expedite, and again on the envelope. The letter must state the reason(s) why the applicant feels the case should be expedited, and the request should be supported by adequate and relevant documentation.

Adjustment of Status/Permanent Residence:
For general information, please see our information on "Lawful Permanent Residency"; "How Do I Change From One Nonimmigrant Status to Another?"; or "Country Specific Adjustment". All Forms I-485, Refugee, Asylee, Haitian applications are filed with the Nebraska Service Center. On this site, we have new information on adjustment of status for asylees (including expected timeframes for processing).
 
Age Outs:
"Age out" cases involve the children of principal aliens or U.S. citizens. Sometimes, if these children turn 18 or 21 (depending on the type of benefit sought) before their case is processed, they will lose the benefit they are seeking. If your case falls within this category, please indicate on your application that it is an "Age Out" case.

Please note: The above statement may no longer apply to your individual case. On August 6, 2002, President Bush signed into law the Child Status Protection Act (CSPA). This law changes the "Age Out" rules in effect prior to signing of the CSPA which were previously defined under the Immigration and Nationality Act (INA). Under the new law, a child will be prevented from "aging out" due to service processing delays.

Change of Address:
For Naturalization Applications:
Customers with pending applications for naturalization (Form N-400) may report their change of address to the NCSC toll-free at 1 (800) 375-5283. Currently, only applications for naturalization may change their address by telephone. For more information please read.

Designated Civil Surgeons:
For general information on the required medical examination, please see "Designated Civil Surgeons". Most applicants for adjustment of status are required to have a medical examination. A civil surgeon who has been designated by USCIS must conduct the medical examination. Click here to find a listing of Designated Civil Surgeons in your area. You may also call the USCIS National Customer Service Center at 1 (800) 375-5283. You will be asked to provide your zip code. Have a pen or pencil ready to write down the list of civil surgeons in your area.

Doctors interested in being registered as a Designated Civil Surgeon should submit the following to the local District Office:

  • A letter to the District Director requesting consideration
  • A copy of a current medical license
  • A current resume that shows 4 years of professional experience, not including a residency program
  • Proof of citizenship
  • Two signature cards showing name typed and signature below

NSC Ombudsman

The Nebraska Service Center Ombudsman (NSCO) was established as a full-time permanent position on December 30, 2000; and reports to the Director, NSC. It does not report to the Department of Homeland Security Citizenship and Immigration Ombudsman.

The NSCO generally accepts complaints and requests for intervention or assistance from Congressional offices, stakeholder or community-based organizations, or individual customers where normal means have not resulted or will not result in fair, consistent, effective, and/or efficient administration of a decision and/or service rendered by the NSC. The significance of the impact to the applicant, petitioner, or beneficiary has a bearing on whether the complaint or request will be accepted. Where an individual case is involved, a benefit must generally have been denied; and a motion, an appeal, or a like submission must generally have been subsequently filed (e.g., Forms I-730). Where multiple cases are involved, there must generally be indications of inconsistent decisions or systemic problems.

When the NSCO accepts a complaint or request, either the NSCO or the Director's secretary will telephonically notify the complainant, requestor, or their representative.

The NSCO will decline frivolous complaints and requests. Non-frivolous complaints or requests may be declined due to existing caseload, time or other constraints. The NSCO does not usually acknowledge declined complaints or requests. Frivolous complaints or requests are discarded. A declined non-frivolous complaint or request is forwarded to the appropriate NSC or USCIS office for action. It is the responsibility of that office to contact the complaintant or requester, as appropriate.

Additionally, the NSCO does not have jurisdiction over a case that has been transferred to another jurisdiction, for which an appellate authority has rendered its decision, or that is under investigation by federal enforcement personnel. The NSCO does not usually acknowledge complaints or requests that are declined due to lack of jurisdiction.

The NSCO issues an annual report that details the criteria against which complaints and requests are evaluated, and that contains anecdotal stories and statistics to describe the services rendered. Copies of the annual report may be obtained by writing to the NSCO.

Complaints and requests must be written, accompanied by copies of supporting documentation, and mailed to the NSCO.

It is important to note that:

  1. A complaint or request for intervention or assistance does not remove responsibility from the applicant, petitioner, or beneficiary to comply with all statutory and regulatory provisions of the immigration law of the United States.
  2. Envelopes or correspondence addressed to the attention of the "Director" or the "Director or Ombudsman" may be assigned by the Director to someone other than the Ombudsman.
  3. All mail submitted to the NSCO is subject to the same processing as all other mail received at the NSC. That is to say that the mail is opened and examined for live petitions, applications, and money by authorized mailroom personnel; and will be processed in a routine manner, thereby preserving the integrity of the services rendered by the NSCO.
  4. If the complaint or request involves sensitive information or documentation, then the complainant or requester must ask that the NSCO initiate contact by telephone. The NSCO will contact the complainant or requester to ascertain the nature of the sensitive information or documentation. Special arrangements may be made to facilitate submission of the complaint or request in a way that protects the sensitivity of the information, as well as the integrity of the services rendered by the NSCO.
  5. The receipt number for the petition, application, motion and/or appeal must be included in correspondence to the NSCO.
