Former LA Ram Sentenced In eBay Internet Fraud Schemes


Former Los Angeles Ram Kevin McLain, 47, of Newport Beach, was sentenced today in Federal Court in Los Angeles for his participation in two separate Internet fraudschemes. The two cases were consolidated for sentencing before the Honorable DeanD. Pregerson. McLain received a sentence of 2 ½ years (30 months) in Federal prison. McLain pled guilty in January of this year to 8 counts of mail fraud based on hiscriminal conduct in the Los Angeles area while a user of eBay.com, the online auction site, during late 1998 through late 1999. The indictment had alleged that during that time period, McLain posted various items for sale on eBay and collected the sellers’ money, but failed to deliver the purchased items and did not refund the payments. In April of this year, McLain pled guilty to unrelated charges contained in an indictment which was transferred to Los Angeles from the District of Colorado. McLain pled guilty to two of the five charges contained in the Colorado Indictment, which alleged that McLain had auctioned items on eBay, received payment from sellers, and then failed to deliver the merchandise or provide refunds to customers during the year 2000.

As a result of the fraud, McLain obtained more than $60,000 from sellers and was ordered to pay over $29,000 in restitution to his victims.
