INITIAL DECISION RELEASE NO. 132

ADMINISTRATIVE PROCEEDING
FILE NO. 3-8527-EAJ

UNITED STATES OF AMERICA

Before the

SECURITIES AND EXCHANGE COMMISSION

Washington, D.C.

In the Matter of RITA VILLA

AMENDED ORDER : October 13, 1998

APPEARANCES: Richard Humes, James A. Brigagliano, and John J. Nicholas for the Division of Enforcement, Securities and Exchange Commission

Eric Landau and Steven Aranoff for the Applicant

BEFORE: Robert G. Mahony, Administrative Law Judge

On September 23, 1998, I issued an initial decision ordering the Commission to pay Rita Villa $122,075.22 in attorney’s fees, plus an additional $29,172.18 for reimbursement of costs.

The award of attorney’s fees within the initial decision failed to reflect 152.75 hours of work performed by her counsel during the Division of Enforcement’s investigation and prior to the issuance of the Order Instituting Proceedings. The correct amount of attorney’s fees, when calculated to include a cost of living adjustment for the relevant period, should reflect an additional 152.75 hours in 1993 and 1994 at $131.47 per hour, or $20,082.04.

Accordingly, the award granted Villa on September 23, 1998 is amended to include an additional $20,082.04 in attorney’s fees.

AMENDED ORDER

The Commission shall pay Rita Villa the sum of $142,157.26 as an attorney’s fee, plus an additional $29,172.18 for reimbursement of costs.
