This application for review concerned the Regional Director's (RD's) decision dismissing a petition to consolidate seven bargaining units. The RD concluded that the proposed unit was not appropriate. The Authority granted review and concluded that the RD failed to apply established law. The case was remanded for further processing consistent with this decision.
The Authority explained that section 7112(d) of the Statute permits consolidation of two or more bargaining units represented by the same exclusive representative if the Authority considers the larger unit to be appropriate. Here, the Authority found that the RD did not properly evaluate the community of interest criteria, and that it was necessary to remand the petition for further findings. The Authority concluded that the proposed unit promoted effective dealings and the efficiency of operation of the agency, satisfying the second and third statutory criteria.
