The Arbitrator granted the Union's request for attorney fees sought pursuant to 5 U.S.C. § 5596(b)(1)(A)(ii). The Authority remanded this case to the parties for resubmission to the Arbitrator to determine whether any employees lost pay, allowances, or differentials as a result of the Agency's unjustified and unwarranted personnel action found in the initial award. The Authority found that it was unclear whether any employees lost pay as a result of the unjustified and unwarranted personnel action found by the Arbitrator.
