The Arbitrator awarded the Union attorney fees in the amount of $ 3,225. The Authority denied the Agency's exceptions after concluding that the Agency failed to establish that the award was deficient. The Union's request that the Authority award the Union attorney fees was also denied. The Authority noted that it has specifically ruled that when an arbitrator has resolved a grievance over an unjustified or unwarranted personnel action, the arbitrator, not the Authority, is the "appropriate authority" for resolving the request for an award of attorney fees. .
