This award resulted from a remand ordered by the Authority in 56 FLRA 339 (2000). On remand, the Arbitrator addressed the Authority's request to clarify the basis for the initial award.
The Authority found that the award, as clarified, demonstrated that the Arbitrator properly enforced a provision of the parties' collective bargaining agreement and accordingly, denied the Agency's exceptions. The Authority rejected the Agency arguments that the award was contrary to management's right to assign work and select under § 7106(a)(2)(B) and (C) of the Statute, or that it failed to draw its essence from the agreement.
