United States Department of the Army United States Army Garrison and AFGE, Case No. AT-RP-00067 (Decided May 3, 2001)

      The Authority denied this application for review because AFGE failed to demonstrate that review was warranted under 5 C.F.R. 2422.31(c). The Authority noted that 5 C.F.R. 2422.31(c) provides that it may grant an application for review when the application demonstrates that there is a genuine issue over whether the Regional Director has: failed to apply established law; committed a prejudicial procedural error; committed a clear and prejudicial error concerning a substantial factual matter.

      AFGE claimed that review was warranted on the ground that the RD erred in determining that AFGE's election objection dated October 13, 2000 was not timely filed under 5 C.F.R. § 2422.26(a). The Authority found that the RD properly concluded that those objections were not timely filed. Accordingly, the Authority concluded that AFGE did not demonstrate that there was a genuine issue warranting review and denied the application for review.
