National Treasury Employees Union Chapter 68 and U.S. Dept. of the Treasury Internal Revenue Service, Andover Service Center (Zack, Arbitrator), 0-AR-3380 (Decided June 7, 2001)

      The Arbitrator found that the Agency's failure to bargain violated the parties' agreement, and did not address whether that failure violated the Statute. The Authority concluded that the Union failed to demonstrate that the award was deficient under section 7122(a) of the Statute.

      The Authority has held that arbitrators have great latitude in fashioning remedies for contract violations. Here, the Authority found that there was no basis to conclude that the Arbitrator was required under the Statute to impose a status quo ante remedy. Accordingly, the Authority concluded that the Union did not demonstrate that the Arbitrator erred by declining to grant a status quo ante remedy.
