The Arbitrator denied the Agency's request for reconsideration of his previous award concerning the payment of interest on unpaid per diem. The Authority denied the Agency exception to the Arbitrator's award denying reconsideration of his previous award.
The Authority found that the Agency misconstrued the Arbitrator's award with respect to the payment of interest on unpaid per diem. The Authority found that the Arbitrator did not order the payment of interest on all unpaid per diem. Rather, he ordered the payment of interest only to the extent that such payment was in accordance with all relevant laws and regulations governing the payment of back pay to federal employees. As the Arbitrator directed that any interest payments be in accordance with law, the award, was not contrary to law.
