57 FLRA No. 197

AFGE Council Local 2128 and U. S. Dept. of Defense, Defense Contract Management Agency, DCMC Bell Helicopter, Hurst, Texas (Barnard, Arbitrator), 0-AR- 3529 (Decided July 10, 2002)

Under § 7122(a) of the Statute, an award is deficient if it is contrary to any law, rule, or regulation; or it is deficient on other grounds similar to those applied by federal courts in private sector labor-management relations. After reviewing the record in this case, the Authority concluded that the award was not deficient on the grounds raised in the exceptions and set forth in § 7122(a). The Authority rejected allegations that the award was deficient as incomplete, ambiguous or contradictory, that the arbitrator exceeded his authority, and that it was based on a nonfact.
